| dc.description.abstract | O presente Relatório Científico Final do Trabalho de Investigação Aplicada aborda a seguinte temática: “As Interceções de Comunicações Telefónicas no Âmbito da Investigação Criminal da Guarda Nacional Republicana”, tendo como objetivo geral estudar o atual panorama das escutas telefónicas na Guarda Nacional Republicana e identificar o melhor procedimento para a execução das escutas. Desta forma, surgiu a seguinte pergunta de partida: Qual é o melhor procedimento para potenciar a utilização de escutas telefónicas na estrutura de investigação criminal da Guarda Nacional Republicana? Neste sentido, foram estabelecidos os seguintes objetivos específicos: compreender se o meio de obtenção de prova escuta telefónica ainda é uma ferramenta útil para a investigação criminal da Guarda Nacional Republicana; verificar as condicionantes logísticas para a realização das interceções telefónicas; reconhecer os impactos operacionais das condicionantes logísticas para a realização de escutas telefónicas. No concerne à estrutura do trabalho, este é constituído por 2 partes. A primeira é dedicada ao enquadramento teórico, sendo feita uma abordagem aos requisitos materiais e procedimentais das interceções telefónicas e ainda uma abordagem sobre a estrutura de investigação criminal da Guarda Nacional Republicana. A segunda parte abrange a metodologia seguida e a análise e discussão do trabalho de campo realizado. Em termos metodológicos, este trabalho seguiu o método indutivo, assente numa abordagem qualitativa através de vários métodos de recolha e análise como a observação direta, entrevistas exploratórias e a análise documental e de conteúdo. Neste trabalho conclui-se que o melhor processo para executar as escutas telefónicas consiste numa abordagem multidisciplinar. A centralização deste processo traduz-se numa poupança logística indubitável. Porém, do ponto de vista operacional, tal centralização só compensa se estiverem reunidas as condições de acesso e operabilidade do sistema de escutas Paragon. | pt_PT |
| dc.description.abstract | The present Final Scientific Report of the Applied Research Work addresses the following theme: “Interception of Telephone Communications in the Context of Criminal Investigation by the National Republican Guard,” with the general objective of studying the current state of telephone tapping within the National Republican Guard and identifying the best procedure for executing the taps. Thus, the following starting question arises: What is the best procedure to enhance the use of telephone tapping in the criminal investigation structure of the National Republican Guard? In this regard, the following specific objectives were established: to understand whether telephone tapping as a means of obtaining evidence is still a useful tool for the criminal investigation of the National Republican Guard; to verify the logistical constraints for carrying out telephone interceptions; to recognize the operational impacts of logistical constraints on the execution of telephone taps. Regarding the structure of the work, it is composed of two parts. The first part is dedicated to the theoretical framework, addressing the material and procedural requirements of telephone interceptions and discussing the criminal investigation structure of the National Republican Guard. The second part covers the methodology followed and the analysis and discussion of the fieldwork conducted. Methodologically, this work followed the inductive method, based on a qualitative approach using various collection and analysis methods such as direct observation, exploratory interviews, and documentary and content analysis. This work concludes that the best process for executing telephone taps consists of a multidisciplinary approach. The centralization of this process results in undeniable logistical savings. However, from an operational point of view, such centralization only pays off if the conditions for access and operability of the Paragon tapping system are met. | pt_PT |
