Abstract(s)
No presente trabalho de investigação foi estudado o uso de força física por agente
privado armado, com o objetivo de avaliar as alterações ao conceito do uso legítimo da força
física, abreviadamente tratado neste trabalho como uso da força, trazidas pela incursão de
armas privadas num domínio reservado da soberania do Estado.
Para esse fim, fez-se um estudo de caso sobre a segurança privada armada, segundo
uma estratégia de investigação do tipo qualitativo à luz de um raciocínio indutivo, com o
propósito de avaliar as alterações ao uso da força e inferir os limites aceitáveis à legitimidade
de atuação das empresas de segurança privada armada.
Fica demonstrada uma tendência na consolidação da legitimação e da crescente
aceitação da segurança privada armada. Não obstante, a generalizada falta de regulação,
designadamente por instrumento internacional legalmente vinculativo, e de controlo efetivo
das armas privadas recomendam ação corretiva expedita.
A exceção à regra reside nas companhias de segurança que oferecem serviços de
“operações ofensivas”, com participação direta nas hostilidades, que têm despertado uma
forte rejeição de vários quadrantes, herdando o anátema consignado aos mercenários.
The present research paper delves into the use of force by private armed security agents with the purpose of evaluating changes to the concept of the legitimate use of physical force, hereafter referred to as the use of force, that their presence brings into the realm of State sovereignty. To that end, the research followed the case study on private armed security, through a qualitative data collection approach, under an inductive investigation method in order to evaluate changes to the use of force and infer acceptable limits to the legitimacy of private armed security companies’ operations. It is demonstrated that a current trend puts in evidence that the legitimacy bedrock of private armed security has been established along with a growing acceptance. Nevertheless, the lack of appropriate regulation, in particular an international legally binding instrument, and the effective control of the activity strongly recommends swift action. The exception lies in the companies that offer “offensive operations” in their portfolio, with direct participation in hostilities, that have sparked strong opposition everywhere receiving the anathema assigned to mercenaries.
