- Habeas corpus: supervisory mechanism of involuntary commitmentPublication . Morais, Sofia; Colón, Máximo FernandezHabeas corpus is a measure available to any citizen in the enjoyment of their political rights, and to patients with psychiatric illness, who may request it to the court of the area in which the patient is detained. This procedure aims to put an end to illegal deprivation of freedom, and it includes two types of habeas corpus: preventive and liberatory. Habeas corpus and the appeal of the decision are two supervisory mechanisms of involuntary commitment, which is regulated by the Portuguese Mental Health Act. This article provides a brief description of the provisions and mechanisms regarding the application of involuntary commitment, as well as its supervisory mechanisms. In the clinical psychiatric evaluation conducted, it was concluded that the provisions for the commitment and involuntary treatment were not fulfilled. In summary, it is worth noting the existence of two supervisory mechanisms of involuntary commitment – appeal of the decision and habeas corpus, essential for ensuring the rights of citizens.

Morais, Sofia; Colón, Máximo FernandezO habeas corpus é uma medida ao dispor de qualquer cidadão no gozo dos seus direitos políticos, e do doente com doença psiquiátrica, que a pode requerer ao tribunal da área onde o doente está detido. Este procedimento pretende pôr cobro a privações ilegais de liberdade, existindo dois tipos de habeas corpus: o preventivo e o liberatório. O habeas corpus e o recurso da decisão são dois mecanismos de supervisão do internamento compulsivo, o qual está regulamentado pela Lei de Saúde Mental. No presente artigo realiza-se uma breve descrição relativa aos pressupostos e aos mecanismos de aplicação do internamento compulsivo, e também sobre os mecanismos de supervisão do mesmo. Na avaliação clínico psiquiátrica realizada concluiu-se que não se cumpriam os pressupostos para o internamento nem para o tratamento compulsivo. Em suma, é de relevar a existência de dois mecanismos de supervisão do internamento compulsivo – recurso da decisão e habeas corpus, essenciais para que os direitos dos cidadãos estejam assegurados.
