Abstract(s)
A atividade de investigação criminal contempla um sem número de diligências e
ações de inquérito que, além dos contextos processuais formais, poderá implicar a
necessidade de utilização de meios operacionais, de que são exemplo paradigmático as
viaturas descaracterizadas. O Sistema de Investigação Criminal na PSP está oficialmente
dotado de um parque de viaturas que serve os seus propósitos habituais, mas a exigência da
realidade prática muitas vezes ultrapassa a capacidade dos meios auto existentes.
Havendo uma tramitação adequada dos inquéritos crime em que seja passível a
apreensão de viaturas, quer por terem sido utilizadas quer por se considerarem lucro da
atividade criminosa, poderá vir a despoletar-se o procedimento com vista à sua utilização
operacional. Esta modalidade, que se irá examinar, além de permitir um aumento do
parque de viaturas disponíveis para a missão policial, opera numa ótica de recuperação de
ativos e também de demonstração aos criminosos que, mais que a condenação penal que
lhes caiba, poderão sentir o abalo económico do instituto da perda em favor do Estado,
pois os bens utilizados ou os lucros ilegítimos que obtiveram, provocaram certamente
lesões à sociedade materializadas na consumação do crime investigado.
The criminal investigation activity includes a large number of diligences and investigation actions that, in addition to the formal procedural contexts, may require the use of operational means, such as unmarked vehicles. The Criminal Investigation System in the PSP is officially endowed with a fleet of vehicles that serves its usual purposes, but the demands of practical reality often exceed the capacity of the existing vehicles. If there is an appropriate procedure for criminal investigations in which vehicles may be seized, either because they have been used or because they are considered to be proceeds from criminal activity, the procedure for their operational use may be triggered. This modality, which will be examined, in addition to allowing an increase in the number of vehicles available for the police mission, operates in a perspective of asset recovery and also of demonstrating to criminals that, more than the criminal conviction applyed to them, they may feel the economic shock of the institute of confiscation in favor of the state, since the assets used or the illegitimate profits they obtained, certainly caused injuries to society materialized in the consummation of the crime under investigation.
