Perante uma sociedade onde cada vez mais o desrespeito pela autoridade das forças policiais começa a ser banalizado e as diversas formas de criminalidade começam a ser vistas como um fenómeno comum e vulgar, surge a necessidade de conferir às forças policiais meios e métodos que lhes permitam garantir a autoridade do Estado, salvaguardando os direitos dos cidadãos.
Surge neste contexto o presente Trabalho de Investigação Aplicada subordinado ao tema: “A influência dos condicionalismos legais na eficácia policial das Forças e Serviços de Segurança: o recurso a arma de fogo sobre viatura em movimento no âmbito de um seguimento policial”.
Neste trabalho foi usada a metodologia hipotético-dedutiva.
Após a introdução este trabalho de investigação encontra-se organizado em duas partes: a parte teórica e a parte prática. A parte teórica compreende o resultado da pesquisa bibliográfica, onde se pretende apresentar o “estado da arte” sobre a temática deste trabalho. A segunda parte deste trabalho, compreende a apresentação, análise e discussão dos resultados obtidos nas entrevistas realizadas, que constituem o cerne e centro de gravidade desta investigação. Posteriormente, na fase conclusiva, são apresentadas as conclusões do trabalho, algumas reflexões finais e propostas para novas investigações.
A realização deste trabalho permitiu perceber que existe um conjunto de situações que podem legitimar a utilização de armas de fogo sobre uma viatura em movimento no âmbito de um seguimento policial, mormente a fim de salvaguardar a segurança de terceiros, não se verificando este meio como o mais adequado para conseguir a imobilização da viatura mas sendo, contudo, não raras vezes o único capaz de garantir a autoridade do Estado e, mais do que isso, a salvaguarda dos direitos e da segurança dos cidadãos.
Faced with a society where the increase of disregard for the authority of the police forces begins to be trivialized and the various forms of crime start to be seen as a common and ordinary phenomenon, it is necessary to give police forces means and methods that enable them to ensure State authority, safeguarding the rights of the citizens. In this context arises this Applied Research Work, regarding the theme: "The influence of the legal constraints on the effectiveness of police forces and security services: the use of firearms on a moving vehicle during a police pursuit". In this research was used the hypothetic-deductive methology. After the introduction, this research work is organized in two parts: a theoretical and a practical part. The theoretical part includes the bibliographic review, which shows the "state of the art" of this topic. The practical part includes the presentation, analysis and discussion of the results obtained through the interviews, which form the main core of this research. Later, in the final phase, conclusions, final reflections and proposals for new researches are presented. This work shows that there are a set of situations that can legitimize the use of firearms on a moving vehicle within a police pursuit, particularly in order to ensure the safety of others. Although this is not the most appropriate mean to achieve the immobilization of the vehicle, it is often the only one able to guarantee the State's authority and, more than that, to safeguard the rights and security of citizens.
