O fator motivante do presente trabalho sobre Violência Doméstica Praticada Contra a Mulher: Anàlise Jurídica do atual Panorama Moçambicano deve-se ao elevado número de vítimas envolvidas neste crime de violência, assim como na análise do processo de resposta, relativamente à importância da participação ativa das forças de segurança, nomeadamente a Polícia da República de Moçambique na repressão e prevenção da violência doméstica praticada contra a mulher.
Considerando a importância do ideal de direitos, liberdades e garantias fundamentais num Estado de direito democrático, como a República de Moçambique, inquieta-nos averiguar se as medidas aplicadas nos casos qualificados como crime na lei penal moçambicana, tanto as medidas levadas à cabo no terreno pelos elementos policiais e ao nível de atendimento e acompanhamento das vítimas, são eficazes para facilitar a investigação criminal em casos de violência doméstica.
Para o efeito, analisamos as medidas previstas na legislação moçambicana relativa à violência doméstica bem como a integração da legislação internacional sobre esta matéria no ordenamento jurídico de Moçambique.
The motivating factor of this work entitled Domestic Violence practiced against Women. Legal analysis of the current context in Mozambique, is due to the high number of victims involved in this crime of violence, as well as the analysis of the response process, regarding the importance of active participation of security forces in this case the Police of the Republic of Mozambique to combat domestic violence against women. Considering the importance of the ideal of freedom in a democratic rule of law, the right man, but specifically intended to ascertain whether the measures applied in cases qualified as a crime in the criminal law in Mozambique and measures on the ground by police officers in police stations, the level of care and support for victims, are effective to facilitate the criminal investigation of domestic violence. For this, we analyse the measures which are predicted in Mozambique’s legislation on domestic violence as well as the integration of international law on this matter in Mozambique’s juridical order.
