| dc.description.abstract | Têm-se verificado recentemente diversas alterações legislativas, no que concerne a Investigação Criminal. Exemplos disso mesmo são a Lei de Organização de Investigação Criminal e a Lei de Segurança Interna. A par das alterações a esta legislação, surge uma reorganização das Forças e Serviços de Segurança. Daqui, surgem novos diplomas legais que provocaram uma reestruturação das suas orgânicas, da qual a Guarda Nacional Republicana não foi excepção. A Investigação Criminal da Guarda Nacional Republicana está dependente destes diplomas legais. Como tal, importa apurar quais foram as repercussões imediatas destas alterações na actividade desenvolvida pelos órgãos responsáveis pela investigação. Este facto torna-se ainda mais importante, uma vez que se refere a uma atribuição que concorre directamente para um dos fins últimos do Estado: a segurança. Como forma de apurar essas alterações, é efectuada uma revisão de literatura onde, para além de esclarecidos alguns conceitos, é apurada a evolução das diferentes leis. Além disso, é utilizado o inquérito por entrevista a elementos com funções de destaque na área em estudo, com vista a apurar as implicações práticas de tais reorganizações. De forma geral, todas estas alterações concorrem para uma melhor cooperação e coordenação, entre as diversas entidades com funções de investigação, ou que para ela contribuem. É de facto notável a evolução ocorrida nos últimos anos neste sentido. Porém,existem algumas áreas que carecem ainda de mecanismos para que sejam mais céleres e eficazes. | por |
| dc.description.abstract | Abstract It has been recently verified many legislative alterations, in what refers t o the criminal investigation. As an example, there are the Criminal Investigation and Organization Law and the Internal Security Law. At the same time, it appears the Security Services and Forces reorganization. Therefore, new legal bills are provoking their organic restructuration, in which the Guarda Nacional Republicana is no exception The Guarda Nacional Republicana‟s Criminal Investigation is dependent of these legal bills. Likewise, it matters to uncover the immediate repercussions of these changes, in the activity developed by the investigation responsible organs. This fact becomes even more important, once it refers to an attribution that directly concurs to one of the State main goals: the security. To reveal these alterations, it is done a literary revision where, besides uncovering some concepts, it exposes the different laws‟ evolution. In addition is used an inquiry by interview to highlighted elements within the studied functions with the objective of revealing the real implications of such reorganizations. In general, all of these changes concur to better cooperation and coordination, between the various entities that have investigation functions, or that contribute greatly to it. It is remarkable the evolution occurred, in the last few years, on this matter. However there are still some areas that need swifter and more effective mechanisms. | por |
