Abstract(s)
O objeto desta pesquisa está centrado no exame dos múltiplos enfoques
sobre o controle da criminalidade no âmbito da investigação policial, tendo como
baliza uma teoria tridimensional. A análise do papel da investigação policial no
Estado Democrático de Direito, à luz da teoria tridimensional, aborda três
perspectivas fundamentais, conforme o ponto de vista de cada um dos atores
que protagonizam o fenômeno criminal (sociedade, investigado e Estado). O
estudo tridimensional da investigação policial permite ao pesquisador identificar
a função ideal do Estado Democrático de Direito diante dos conflitos decorrentes
da colisão de forças diretivas opostas que são as aspirações da sociedade e do
investigado. Além disso, possibilita a construção de um modelo de investigação
policial voltado para solução dos conflitos através da promoção dos direitos
humanos.
The aim of this research is the examination of the multiple focuses on the criminality control in the scope of the police investigation, underpinned by a tridimensional theory. The analysis of the police investigation role in the Democratic State of Law is approached under three fundamental perspectives, according to the point of view of each of the actors who star the criminal phenomenal: society, investigated and State. The tridimensional study on the police investigation allows the researcher to identify the ideal function of the Democratic State of Law, when facing the conflicts resulted from the collision of directive forces that are the aspirations of the society and the investigated. Furthermore, it allows the development of a police investigation model regarding the solution of the conflicts through the exaltation of human rights.
