Abstract(s)
Considerando que o sistema de organização policial português apresenta
especificidades que o tornam num modelo complexo, procurou-se com o presente trabalho
aferir sobre o dever de atuação por parte da Polícia de Segurança Pública, concretamente
na zona terrestre do domínio público marítimo, que é área de jurisdição da Polícia
Marítima, visando contribuir para a otimização da atuação policial no quadro das
atribuições das duas Forças de Segurança. Recorreu-se a uma estratégia de investigação
qualitativa, delimitando o estudo às competências territoriais das Forças de Segurança em
análise, conjugadas com as respetivas atribuições, desenvolvidas no âmbito do Sistema de
Segurança Interna. Concluímos que ambas as Forças de Segurança têm uma área de
jurisdição própria, sem sobreposição territorial, mas sobre elas recai o dever de
cooperação, pelo que deverá a Polícia de Segurança Pública, de forma devidamente
articulada, prestar o necessário apoio à Polícia Marítima, nomeadamente na parte terrestre
do domínio público marítimo. Para o efeito, considera-se pertinente a existência de um
plano de articulação e cooperação, de âmbito nacional, abrangendo diversas áreas de
atuação, nomeadamente a ordem e segurança públicas, a investigação criminal e a
fiscalização.
Bearing in mind the Portuguese police organization system presents itself with specificities that makes it a complex model, this work sought to asses on the duty to act by Polícia de Segurança Pública, more specifically in the terrestrial area of the marine public domain, an area of jurisdiction of the Polícia Marítima, with the goal of contributing to police action optimization within both Security Forces duties framework. A qualitative research strategy was used, narrowing the study to the analysed Police Forces territorial jurisdiction, combined with their duties, carried within the scope of the Internal Security System. We have concluded that both Security Forces have their own area of jurisdiction, without territorial overlap, but they also have cooperation duty, meaning that Polícia de Segurança Pública must, in a proper articulated way, give Polícia Marítima all the necessary support, namely in the terrestrial part of the marine public domain. To do so, it is considered relevant the existence of an articulation and collaboration plan, with national scope, covering several action areas, namely public order and security, criminal investigation and inspection.
