Análise do regime legal de prestação de serviço dos Polícias da PSP em funções nas Polícias Municipais de Lisboa e Porto: da relevância de preservar o estatuto de órgão de Polícia criminal

| dc.description.abstract | O presente trabalho é uma investigação na área temática das ciências policiais que procura fazer uma análise aprofundada sobre o enquadramento jurídico das Polícias Municipais em geral e das Polícias Municipais de Lisboa e do Porto em particular, com o foco no enquadramento legal dos polícias da PSP em funções nas Polícias Municipais de Lisboa e do Porto. Questiona-se a condição destes polícias face ao estatuto maior que os enquadra, no caso, o Estatuto do Pessoal da Polícia de Segurança Pública e qual a intenção do legislador nos diferentes momentos legislativos que vieram a enquadrar a atividade de polícia municipal. Para melhor responder à nossa problemática, recorremos às teorias de interpretação jurídica, apoiadas na análise documental e na realização de entrevistas aos diferentes atores que diretamente criaram o regime legal, específico, das Polícias Municipais de Lisboa e do Porto, concluindo-se que, apesar de subsistirem divergências, os polícias da PSP em serviço nas polícias municipais de Lisboa e do Porto não gozam do estatuto de órgão de polícia criminal. | pt_PT |
| dc.description.abstract | This paper is an investigation in the field of police sciences that seeks to analyse in depth the legal framework of the Municipal Police in general and the Municipal Police of Lisbon and Porto in particular, with a focus on the legal framework of PSP police officers working in the Municipal Police of Lisbon and Porto. We questioned the status of these police officers in relation to the higher statute that governs them, in this case, the Personnel Statute of portuguese police (PSP) and what the legislator's intention was in the different legislative moments that came to govern municipal police activity. In order to provide a better answer to our problem, we used theories of legal interpretation, supported by documentary analysis and interviews with the different actors who directly created the specific legal regime of the Lisbon and Oporto municipal police, concluding that, although there are still differences, the PSP police officers working in the Lisbon and Oporto municipal police do not enjoy of the criminal police body status. | pt_PT |
