| dc.description.abstract | Com a internacionalização da criminalidade organizada e o aparecimento de novos tipos de criminalidade, assumiu particular relevância a definição de uma política criminal preventiva e repressiva. Deste modo, o legislador português elaborou a Lei 101/2001, de 25 de Agosto, que aprovou o Regime Jurídico das Acções Encobertas para Fins de Prevenção e Investigação Criminal. Este regime não só ampliou as finalidades do recurso ao agente infiltrado e o seu âmbito de aplicação, como também prevê que um terceiro, sob o controlo da Polícia Judiciária, e desde que autorizado judicialmente, possa inserir-se em grupos criminosos, actuando encobertamente no meio destes, visando obter informações e provas para incriminação dos suspeitos. Contudo, o legislador não definiu quem pode ser “terceiro”, nem descreveu como será efectuado o seu controlo. Neste sentido, a nossa pesquisa tem, como objectivo fundamental, analisar se é admissível a actuação do particular como agente infiltrado. Para o efeito, analisar-se-á a matéria na perspectiva do direito comparado, com o objectivo de demonstrar as soluções encontradas pelos ordenamentos jurídicos de alguns países – Espanha, França, Alemanha, Argentina e Brasil – para a problemática em questão. No entanto, antes de tal abordagem, analisar-se-á a figura do informador e do arguido arrependido, como também procurar-se-á argumentar a defesa do recurso ao método do agente infiltrado por parte das Forças de Segurança. Para complementar o estudo recorreu-se à entrevista, onde participaram intervenientes com reconhecidos conhecimentos na área do Direito Penal e Processual Penal. Presentemente, é fulcral reflectir acerca de tão relevante problemática, uma vez que este meio excepcional de obtenção de prova actua no limite dos direitos, liberdades e garantias fundamentais do cidadão. | pt_PT |
| dc.description.abstract | With the internalization of the organized crime and the appearance of new types of crimes, it has assumed a particular relevance the definition of a preventive and repressive criminal policy. Therefore, the Portuguese legislator puted in to force the Law 101/2001, 25th August, that approved the “Legal Regime of Covert Actions for the Purpose of Prevention and Criminal Investigation.” The scheme not only expanded the purposes for the use of undercover agent and its scope, but also provides that a third, under the control of the Judiciary Police, and since authorized by court, can enter into criminal groups, acting covertly in the middle of them, trying to obtain information and proofs to incriminate suspects. Although, the legislator didn’t define who can be the “third”, neither mentioned how the control is done. In this sense, our research has as fundamental objective: analyze if it is admissible the particular action as undercover agent. To this, it’s done a short study of comparative law, in order to demonstrate the solutions found by the laws of some countries – Spain, France, Germany, Argentina and Brazil – to the problem in question. However, before relying on international law, it will be analyze the image of the informer or the sorry defendant, but we also will try to argue the defense of using the method of the undercover agent by Security Forces. To complement the study we used interviews, where have participated people with recognized experience in the area of Criminal Law and Criminal Procedure. Now, is crucial to reflect on such a relevant issue, once that this exceptional way to obtain proofs acts on the limit of the, freedoms and guarantees. | pt_PT |
