Abstract(s)
A Polícia do Exército tem como uma das suas missões a Atividade de Detenção. Esta atividade implica a evacuação e internamento de todas as categorias de indivíduos sobre as quais recaiam medidas de controlo e guarda, nomeadamente, prisioneiros de guerra, deslocados, transviados e refugiados.
O Estabelecimento Prisional Militar, sediado em Tomar, é da responsabilidade do Exército e reúne reclusos das Forças Armadas e da Guarda Nacional Republicana que se encontram a cumprir pena de prisão e/ou medidas de coação, onde os militares da especialidade de PE têm um papel importante para “Ajudar a Cumprir”.
Aos militares que prestam serviço no Estabelecimento Prisional Militar, em particular, no Pelotão de Guarnição e Segurança, é-lhes ministrada formação em cinco grandes áreas: (i) treino físico; (ii) tiro; (iii) formação jurídica; (iv) formação polícia do exército; (v) cursos específicos de guarda prisional ministrados pela Direção Geral de Reinserção e Serviços Prisionais. Esta última área formativa representa uma lacuna na formação dos militares do PGS, pois o Exército recorre a uma entidade externa, que está sob a alçada do Ministério da Justiça, para mitigar a formação necessária para o desempenho da atividade de Detenção no Estabelecimento Prisional Militar.
Este Trabalho de Investigação Aplicada, apoiou-se numa metodologia do tipo indutivo, e seguiu uma abordagem qualitativa. Para o efeito, tem como objeto de estudo a Polícia do Exército e o Estabelecimento Prisional Militar, cujo objetivo geral é perceber se o ramo mais indicado para o cumprimento da missão do Estabelecimento Prisional Militar é efetivamente o Exército através da Polícia do Exército, ou se estas funções deverão ser desempenhadas por outro ramo das Forças Armadas ou Forças de Segurança – através da Marinha, com a Polícia Naval, através da Força Aérea, com a Polícia Aérea ou através da Guarda Nacional Republicana.
One of the Army Police's missions is Detention, which involves the evacuation and internment of all categories of individuals subject to control and custody measures, namely prisoners of war, displaced persons, transients, and refugees. The Military Prison, based in Tomar, is the responsibility of the Army and brings together prisoners from the Armed Forces and the National Republican Guard who are serving prison sentences and/or coercive measures, where military personnel from the PE specialty play an important role in “Helping to Comply”. The soldiers who serve in the Military Prison, particularly in the Garrison and Security Platoon, are given training in five main areas: (i) physical training; (ii) shooting; (iii) legal training; (iv) army police training; (v) specific prison guard courses given by the General Directorate of Reintegration and Prison Services. This last area of training represents a gap in the training of PGS soldiers, as the Army uses an external entity, which is under the Ministry of Justice, to mitigate the training needed to carry out the activity of Detention in the Military Prison. This Applied Research Project was based on an inductive methodology and followed a qualitative approach. For this purpose, the object of study is the Army Police and the Military Prison. The general objective is to understand whether the branch best suited to fulfilling the mission of the Military Prison is actually the Army through the Army Police, or whether these functions should be carried out by another branch of the Armed Forces or Security Forces - through the Navy, with the Naval Police, through the Air Force, with the Air Police or through the National Republican Guard.
