O segredo profissional constituiu um dos elementos estruturantes da deontologia
médica. A prática da medicina militar reveste-se de características únicas que poderão, em
situações particulares, justificar a apreciação e revalorização dos princípios subjacentes ao
elemento ético referido, contrapondo valores de interesse pessoal-individual com valores
supra-individuais, relacionados com princípios de segurança pessoal, coletiva e de eficácia
operacional. Procedeu-se à análise dos elementos ético-deontológicos respeitantes ao
segredo profissional colocados no exercício da medicina em meio militar, bem como às suas
implicações e repercussão nas Forças Armadas Portuguesas. A partir de uma estratégia
hipotético-dedutiva, realizou-se um estudo misto, com integração de elementos
quantitativos, baseados em inquérito de escala ordinal, em elementos qualitativos, recolhidos
em análise documental e entrevistas semiestruturadas. Como conclusões salienta-se a
inexistência de um quadro normativo claro que permita, neste âmbito, a resolução de
conflitos éticos no contexto da saúde militar, embora seja admissível, no plano deontológico,
em casos muito excecionais, a confrontação do valor referido, com a defesa dos superiores
interesses da instituição militar. Recomenda-se para o efeito, a criação de doutrina
consagrando os aspetos referidos, bem como de formação teórica e prática sobre o tema nas
Forças Armadas Portuguesas.
Professional confidentiality is a structuring element of medical deontology. The practice of military-medicine has unique characteristics that may, in specific situations, justify the appreciation and revaluation of the underlying principles of confidentiality, confronting values of personal-individual interest with supra-individual values related to personal and collective safety as well as operational effectiveness. The present study analysed ethical and deontological elements regarding confidentiality in the practice of medicine in military environment, as well as their implications and repercussions on the organization of the Portuguese Armed Forces. For this purpose, according to a hypothetical-deductive strategy, a mixed study was carried out, with integration of quantitative data based on an ordinal scale survey, and qualitative information supported by document analysis and semi-structured interviews. In conclusions, we highlight the lack of a clear normative framework that allows, in this context, the resolution of ethical conflicts in the practice of military health care providers. In exceptional cases, it is deontologically admissible to confront medical confidentiality with the defence of superior personal and collective interests. For this purpose, we recommend the creation of doctrine about these aspects, as well as training on the subject within the Portuguese Armed Forces.
