Crimes contra animais de companhia: a operacionalidade dos organismos nacionais na proteção e intervenção de animais vítimas de maus-tratos e abandono

Ao longo do tempo, os maus-tratos e o abandono de animais têm ganho uma cres cente preocupação. No entanto, continua a ser um problema acentuado na nossa socie dade.
Neste contexto, com o presente trabalho de investigação, pretende-se contribuir
para uma melhor compreensão dos crimes perpetrados contra os animais de companhia,
inclusive identificar caraterísticas e fatores relacionados com situações de abandono,
maus-tratos e negligência de animais de companhia em ambiente familiar, no sentido de,
a partir destes, identificarmos possíveis situações de risco e possibilitar uma rápida inter venção por parte dos partícipes. Ou seja, pretende-se estudar o problema e aplicar méto dos e instrumentos suscetíveis de diminuir o crime contra os animais de companhia, bem
como averiguar como operam os organismos nacionais com competência para intervir na
cadeia preventiva no âmbito destes tipos de crime.
Pretende-se, ainda, saber se será uma mais-valia criar uma Comissão de Proteção
de Animais de Companhia (instituição oficial não judiciária com autonomia funcional),
apoiada nas ciências criminológicas, uma vez que o recurso à Criminologia para a pre venção dos delitos criminais contra animais de companhia constitui uma área ainda por
explorar.
Para cumprir com este objetivo de estudo, analisámos dados inerentes a esta prá tica criminal desde 2014 a 2021. Recorremos, também, à realização de entrevistas semi estruturadas, a especialistas/organismos de comprovado conhecimento sobre a matéria,
ou com responsabilidades designadamente na prevenção e repressão do crime contra ani mais de companhia.
De uma forma generalizada, pretendemos sensibilizar toda a comunidade sobre
esta problemática, inclusive incitar boas-práticas, uma vez que os maus-tratos a animais
degradam a nossa humanidade, sendo fundamental o contributo de várias ciências para
garantir a tutela efetiva dos seus direitos.
Over time, mistreatment and abandonment of animals has gained increasing con cern. However, it continues to be an accentuated problem in our society. In this context, the present research work intends to contribute to a better under standing of the crimes perpetrated against companion animals, including identifying char acteristics and factors related to situations of abandonment, situations of mistreatment and neglect of companion animals in family environment, in the sense that, based on these, we can identify possible risk situations and enable a quick intervention by the par ticipants. That is, we intend to study the problem and apply methods and instruments that are likely to reduce crime against pets. However, to understand how the national bodies with competence to intervene in the preventive chain in the context of these types of crime operate. We also intend to find out if it would be an asset to create an Animal Protection Commission (official non-judiciary institution with functional autonomy), supported by criminological sciences, since the use of Criminology for the prevention of criminal of fenses against company constitutes an area yet to be explored. In order to fulfill this study objective, we analyzed data inherent to this criminal practice from 2014 to 2021. We also used semi-structured interviews with specialists/or ganisations with proven knowledge of the matter, or with responsibilities namely in the prevention and repression of crime against companion animals. Generally speaking, we intend to raise awareness in the entire community about this issue, including inciting good practices, since mistreating them also degrades our humanity, and the contribution of various sciences is essential to guarantee their effective protection.
