O direito universal dos cidadãos nacionais à proteção social (PS) está consagrado na
Constituição da República Portuguesa (CRP), incumbindo ao Estado garantir o
funcionamento e subsidiação do sistema de segurança social (SS).
Os militares representam um grupo de cidadãos cuja missão está associada a riscos
particulares e a quem é exigido níveis de aptidão física e psicológica elevados, que são
condições para que possam ser considerados aptos para o serviço.
Nesta medida, a PS dos militares na ocorrência das eventualidades que provoquem
incapacidade permanente é particularmente relevante e deve ser analisada à luz da Condição
Militar (CM). Esta, como condição jurídica aplicada aos militares por imperativo
constitucional e legal, implica restrições ao exercício de direitos fundamentais e a atribuição
de deveres específicos aos militares, prevendo, igualmente, a salvaguarda de determinados
direitos.
A presente investigação pretende avaliar o sistema de proteção dos militares nas
eventualidades conducentes a incapacidade permanente e identificar eventuais lacunas ou
insuficiências do sistema. Procede-se à análise do regime de PS dos militares portugueses,
bem como à análise dos sistemas de proteção dos militares em países congéneres e à
avaliação da perceção dos militares portugueses relativamente ao regime de PS que lhes
assiste.
Finalmente, apresentam-se propostas de medidas que possam contribuir para a
melhoria do regime de PS dos militares
The universal right of national citizens to social protection is enshrined in the Portuguese Constitution. The responsibility to ensure the functioning and financing of the social security system belongs to the State. The military are a particular group of citizens whose mission is associated with risk and to whom high levels of physical and mental fitness are demanded as conditions for service. Social protection of the military in case of health incapacity is particularly relevant and should be analysed in light of the Military Condition. This legal status, which is a constitutional imperative, implies special duties and restrictions to rights of the military personnel, but also predicts certain rights. An analysis of the portuguese military social protection system in the case of health incapacity is held as a means to identify possible inadequacies of the system. Social protection of the military is studied, as well as the social security systems of the military in comparable countries. The perception of the military regarding their own social protection system is also analysed. Finally, measures intended to upgrade the social protection system are suggested.
