Abstract(s)
Subordinado ao tema “A Eficácia do Mandando de Detenção Europeu no Combate
à Criminalidade”, o presente trabalho resulta de uma investigação que procura identificar e
analisar as potencialidades e inovações resultantes da aplicação do Mandado de Detenção
Europeu e dos respetivos mecanismos de cooperação judicial e policial internacional no
combate à emergente criminalidade, consequente da adoção de uma política de livre
circulação de pessoas e construção de um espaço comum Europeu.
Face ao exposto, os objetivos deste trabalho ambicionam apurar o grau de eficácia
produzido pelo Mandado de Detenção Europeu e as suas vantagens no combate à
criminalidade, as principais novidades relativamente ao tradicional sistema de extradição
utilizado no passado, a identificação de obstáculos na utilização deste instrumento jurídico
através do estudo dos mecanismos de cooperação judiciária praticados dentro da União, e
obter algumas recomendações de forma a conceber melhorias na futura utilização desta
ferramenta.
Devido à natureza jurídica do presente trabalho, a metodologia de investigação
utilizada recorre ao método dedutivo através de uma análise documental e da realização de
entrevistas. Obedecendo ao percurso metodológico proposto pelas orientações dadas pela
Academia Militar, e com recurso a uma abordagem sistemática dos instrumentos de
investigação utilizados, foi possível responder às pergunt as de investigação elaboradas e
consequentemente, assegurar os objetivos propostos.
Em resposta ao rápido desenvolvimento da crescente criminalidade que se verifica
na atualidade, a União Europeia sentiu necessidade de substituir o tradicional processo de
extradição, que se mostrava inadequado às necessidades implementadas pelas novas
políticas Europeias, por um processo mais eficaz de detenção e entrega de pessoas
procuradas dentro do espaço da União. Perante esta necessidade, é criado a 12 de Julho de
2002 o Mandado de Detenção Europeu, que se traduz numa decisão judiciária emitida por um Estado-Membro com vista à detenção e entrega por outro Estado-Membro de uma
pessoa procurada para efeitos de procedimento penal ou para cumprimento de uma pena ou
medida de segurança privativa de liberdade. Com este instrumento jurídico surgiu a
necessidade da União Europeia criar e adotar novos mecanismos de cooperação judiciária internacional em matéria penal baseados no princípio do reconhecimento mútuo, resultante do Conselho Europeu de Tampere de 1999, que assenta em noções de equivalência e confiança integrados numa filosofia de construção de um espaço judiciário comum.
A implementação do Mandado de Detenção Europeu representa um enorme salto
qualitativo em matéria de cooperação judicial, traduzindo -se numa justiça desburocratizada no que toca à extradição de pessoas dentro do espaço da União Europeia. Esta ferramenta
originou um processo célere, simples e eficaz, permitindo a atuação em tempo real da detenção dos agentes do crime, assumindo-se como um precioso instrumento de combate à criminalidade.
Abstract Subordinated to the theme ‘The Efficacy of the European Arrest Warrant in the Fight Against Crime’, the present paperwork is the result of an investigation that attempts to identify and analyze the potential and innovations gained with the implementation of the European Arrest Warrant and its police and judicial cooperation at international level in the fight against the emerging crime, consequence from the adoption o f a free movement of persons policy and the construction of a common European space. Based on the above, this paperwork’s objectives aim to determine how efficient the European Arrest Warrant is, its advant ages in the fight against crime and its new updates regarding to the traditional extradition process used in the past, the identification of difficulties in the use of this juridical instrument by studying the judicial cooperation mechanisms applied in the European Union, and in order to get some recommendations to conceive improvements in the future use of it. Due to the juridical nature of this paperwork, the investigation methodology used relies on the deductive method by documental analysis and interviews. Obeying to the methodological guide proposed by the orientation given by the Military Academy and using a systematic approach to the investigation instruments, it was possible to answer to the investigation questions and ensure the proposed objectives. In order to answer the quick development of the increasing crime that we verify nowadays, the European Union felt the urge to replace the traditional e xtradition process, which was not responding to the new policies implemented by the European Union, by a more efficient process of arrest and surrender of wanted people inside the European Union territory. Under this scenario, it is created on the 12thJuly 2002 the European Arrest Warrant, which results in a judicial decision issued by a Member S tate with a view to the arrest and surrender by another Member State of a requested person, for the pur pose of conducting a criminal prosecution or executing a custodial sentence or detention order.With this juridical instrument, came the need for the European Union to create and adopt a new international judiciary cooperation mechanisms in criminal matters, based on the mutual recognition principle resulted by the European Council of Tampere in 1999, which is integrated in a philosophy of construction of a common judicial area. The implementation of the European Arrest Warrant represents a huge step in matters of judicial cooperation, by representing a non-bureaucratic justice in terms of extradition of people in the European Union. The European Arrest Warrant created a quicker process, much more simple and effective, enabling a real time action in the arresting of criminals, assuming itself as a very important instrument in the crime fighting.
