As Polícias Municipais em Portugal: enquadramento jurídico, modelos de atuação e os desafios da descentralização da segurança

O presente artigo analisa a complexa posição da Polícia Municipal na arquitetura de segurança interna de Portugal. Através de uma análise documental e jurídica, examina-se a tensão constitucional entre a primazia do Estado na segurança interna e o papel cooperativo das autarquias. A investigação aprofunda a Lei-Quadro, que define o mandato administrativo das Polícias Municipais, e o regime especial de Lisboa e Porto, que gera um paradoxo ao utilizar agentes da Polícia de Segurança Pública com competências limitadas. Analisa-se o impacto da descentralização, argumentando que a transferência de competências de segurança é mais estratégica do que operacional. O artigo explora ainda a implementação do Policiamento de Proximidade, identificando os seus desafios estruturais. A análise culmina no debate sobre a expansão das competências da Polícia Municipal para órgão de polícia criminal, à luz do parecer da Procuradoria-Geral da República. Conclui-se que o futuro das Polícias Municipais depende de uma decisão política sobre o modelo de segurança local, propondo-se recomendações para a clarificação legislativa e cooperação inter-institucional.
This article analyzes the complex position of the Municipal Police in Portugal's internal security architecture. Through a documentary and legal analysis, it examines the constitutional tension between the State's primacy in internal security and the cooperative role of local authorities. The research delves into the Framework Law, which defines the Municipal Police administrative mandate, and the special regime for Lisbon and Porto , which creates a paradox by using Portugues Police officers with limited competencies. The impact of decentralization is analyzed, arguing that the transfer of security competencies is more strategic than operational. The thesis also explores the implementation of Community Policing, identifying its structural challenges. The study culminates in an analysis of the debate on expanding the Municipal Police competencies to become a criminal police body, in light of the opinion from the Attorney General's Office. It is concluded that the future of the Municipal Police depends on a political decision about the desired local security model, proposing recommendations for legislative clarification and inter-institutional cooperation.
