Abstract(s)
A contrafação é um fenómeno criminal presente nos nossos dias, claramente transnacional,
constituindo, pela sua dimensão, um dos grandes flagelos do século XXI. Pese embora
todos os esforços que as autoridades de enforcement têm vindo a desenvolver na luta
contra a contrafação, constata-se uma tendência crescente deste fenómeno, pelo que,
atendendo ao facto de a temática em apreço ainda ser pouco explorada, sobretudo nas
organizações policiais, propusemo-nos a refletir sobre o papel da Polícia de Segurança
Pública para a mitigação do fenómeno. Para tal foram entrevistados doze especialistas que,
em razão das particularidades das funções que exercem, encontram-se familiarizados na
definição e operacionalização das diferentes abordagens institucionais, o que lhes permite
contribuir de forma abrangente, variada e estratégica para a problemática em estudo. Em
termos globais, concluiu-se pela necessária melhoria dos mecanismos ao nível da
cooperação policial e judicial, competindo à Polícia de Segurança Pública, para a melhoria
da sua eficácia no combate à contrafação, a adoção de um modelo de policiamento de
proximidade dinâmico, multidimensional, articulado a uma estratégia orientada pelas
informações, incutindo-lhe um forte pendor tecnológico e de inteligência e, desse modo,
contribuir para robustecer e tornar o sistema de proteção aos direitos de propriedade
industrial mais eficaz.
Counterfeiting is a criminal phenomenon present nowadays, clearly transnational, being, due to its dimension, one of the great scourges of the 21st century. Despite all the efforts that enforcement authorities have been making in the fight against counterfeiting, there is a growing trend in this phenomenon, which is why, given the fact that this subject is still little explored, especially in police organizations, we thought it was important to reflect on the role of Public Security Police in mitigating this phenomenon. To this end, twelve specialists were interviewed who, due to the particularities of their positions, are familiar with the definition and operationalization of the different institutional approaches, which allows them to contribute in a comprehensive, varied and strategic way to the problem under study. Globally, we concluded that there is a need to improve mechanisms in terms of police and judicial cooperation, with Public Security Police, in order to improve their effectiveness in combating counterfeiting, adopting a dynamic, multidimensional proximity policing model, linked to an information-oriented strategy, instilling in it a strong technological and intelligence imprint and, this way contributing to strengthen and to make the industrial property rights protection system more effective
