Abstract(s)
O presente Trabalho de Investigação Aplicada tem como tema “O Interrogatório Policial como fase da Investigação Criminal: Técnicas e Métodos”, cujo objetivo geral se centra no apuramento das mudanças necessárias para melhorar a eficácia dos métodos de interrogatório utilizados em Portugal.
Como guia para esta investigação, decidimos começar por abordar o Interrogatório no seu sentido lato e também relativamente aos seus constituintes, como o investigador ou o arguido, estudando fenómenos relevantes para a temática em causa, como a confissão e a falsa confissão.
No que se refere à metodologia, optámos por uma abordagem mista, utilizando um método qualitativo relativamente à análise documental e aos inquéritos por entrevista, e um método quantitativo no que toca aos inquéritos por questionário. Tanto as entrevistas como os questionários foram dirigidos a militares da Guarda Nacional Republicana no ativo, quer especialistas ou Oficiais em posições de chefias, quer aos operacionais que contactam com esta temática no seu serviço diário.
Por fim, para que seja possível, enquanto instituição, suprimir as suas vulnerabilidades relativas ao interrogatório policial, torna-se necessário que a Guarda Nacional Republicana procure dotar as subunidades do dispositivo territorial com os meios necessários par que estas possam desempenhar as suas funções com a máxima eficácia. Existe também a necessidade de se reformular o modelo formativo que engloba este tema, de forma a que os militares que desempenham funções relacionadas com a IC se possam manter atualizados com as práticas promovidas pelo Comando, devendo esta ser uma preocupação da instituição, e não do próprio militar.
The present Applied Research Work focuses on the theme "Police Interrogation as a Phase of Criminal Investigation: Techniques and Methods," with the general objective centered on determining the necessary changes to improve the effectiveness of the interrogation methods used in Portugal. As a guide for this research, we decided to start by addressing Interrogation in its broad sense and in relation to its constituents, such as the investigator or the suspect, studying phenomena relevant to the theme in question, such as confession and false confession. Regarding the methodology, we opted for a mixed approach, using a qualitative method concerning document analysis and interview surveys, and a quantitative method regarding questionnaire surveys. Both the interviews and the questionnaires were directed at active personnel of the Guarda Nacional Republicana, including specialists or Officers in leadership positions as well as operational personnel who face this theme in their daily service. Finally, to overcome its vulnerabilities related to police interrogation, it is necessary for the Guarda Nacional Republicana to supply the territorial subunits with the means necessary for them to perform their functions with maximum effectiveness. There is also a need to reformulate the training model that encompasses this theme so that the military personnel involved in Criminal Investigation can stay updated with the practices promoted by the Command. This should be a concern of the institution, not of the individual officer.
