| dc.description.abstract | A Constituição da República Democrática de São Tomé e Príncipe consagra um vasto leque de catálogo de direitos fundamentais, em que um deles é o direito de se reunir/manifestar-se pacificamente e sem armas. No ordenamento jurídico são-tomense, as forças de segurança, neste caso, a Polícia Nacional de São Tomé é Príncipe, é um dos principais órgãos do Estado cujo a função, é de garantir a ordem e tranquilidade pública, bem como proteger os direitos de liberdades e garantias dos cidadãos. Entretanto, para que esses direitos sejam garantidos, a Polícia Nacional de São Tomé e Príncipe na prossecução dos seus deveres/funções, recorre muitas das vezes ao uso de força para repor a ordem pública. Neste caso, a atuação da polícia deve obedecer aos princípios plasmado da Constituição, ou seja, inerentes à função policial, bem como aos princípios gerais da Administração pública. Sabendo que o princípio de dignidade da pessoa humana contem um valor absoluto na Constituição são-tomense, logo, o Estado tem como a tarefa principal a criação de estratégias que garantem o exercício desses direitos fundamentais do cidadão, bem como, sua proteção e promoção ao longo dos anos. Por fim, para que o direito de reunião e de manifestação sejam garantidos, é necessário que no seu exercício por parte dos cidadãos, os mesmos respeitem os limites e as restrições impostas pela Lei. | pt_PT |
| dc.description.abstract | The Constitution of the Democratic Republic of Sao Tome and Principe enshrines a wide range of catalogues of fundamental rights, in which one of them is the right to meet/manifest itself peacefully and without weapons. In the Legal System of São Tomense, the security forces, in this case, the National Police of São Tomé is Prince, is one of the main organs of the State whose function, is to ensure order and public tranquility, as well as protect the rights of freedoms and guarantees of citizens. However, in order for these rights to be guaranteed, the National Police of São Tomé and Príncipe in the pursuit of their duties/functions, often resortto the use of force to re-reinse public order. In this case, the action of the police must comply with the principles of the Constitution, that is, inherent to the police function, as well as to the general principles of public administration. Knowing that the principle of dignity of the human person contains an absolute value in the Sao Tome Constitution, therefore, the State has as its main task the creation of strategies that guarantee the exercise of these fundamental rights of the citizen, as well as their protection and promotion over the years. Finally, in order for the right of meeting and demonstration to be guaranteed, it is necessary that in their exercise by citizens, they respect the limits and restrictions imposed by the Law. | pt_PT |
