Abstract(s)
O presente Relatório Científico Final do Trabalho de Investigação Aplicada, intitulado «Tutela Legal e Institucional do Militar da GNR no Serviço Operacional» tem por
objetivo perceber quais os tipos de Institutos que visam proteger o militar no decorrer do serviço operacional, no sentido que lhe conferem instrumentos para uma atuação legal e legítima, ciente das responsabilidades inerentes ao exercício das suas funções.
Para a realização deste relatório a metodologia utilizada foi direcionada à análise teórico-descritiva, às pesquisa e análise documentais, de bibliografia, de doutrina e de legislação relevante.
Conclui-se que a tutela, no sentido que configura uma proteção ao militar da GNR
no serviço operacional, abrange uma visão integrada e multidimensional.
Integrada porque são vários os regimes, quer institucionais quer exógenos, que contribuem para alcançar o mesmo objetivo.
Multidimensional porque ante esses regimes existe uma enorme diversidade de aspetos que contribuem para a atuação legal e legítima do militar da GNR.
Conclui-se que estes regimes apesar de distintos estão intimamente relacionados,
pois, em comum, partilham o mesmo objetivo: proteger o militar da GNR no serviço operacional.
Abstract The present Report, entitled «The Legal and Institutional Guardianship of the GNR Soldier at Operational Service» intends to perceive what kind of institutions exist to protect the soldier during operational service, as they grant him instruments for a legitimate and legal performance, being aware, at the same time, of the responsibilities associated with the practice of his duties. Regarding the methodology, the data presented in this Report are based in theoretical and descriptive analysis, as well as in the documental research and analysis of bibliography, relevant doctrine and legislation. One can conclude that guardianship, as it configures protection to the GNR soldier at operational service, comprises a multidimensional and integrated approach. It is integrated because there are several ways, institutional and exogenous, that mean to achieve the same goal. The multidimensionality is grounded on the several aspects that contribute to the legal and legitimate performance of the GNR soldier. The institutions mentioned above are strongly related to each other, though they may be perceived as unlike. They share the same goal – to protect the GNR soldier at operational service.
