Abstract(s)
O mar é um fator especialmente relevante na economia de Portugal, uma vez que 90% das
transações comerciais com o estrangeiro são feitas por via marítima. A geomorfologia peculiar de
Portugal, assim como a sua muito ampla área marítima jurisdicional, associada ao interesse
económico, reforça a importância do conceito da maritime security, sobretudo pelo facto de não
existir desenvolvimento económico sem segurança. A security ao nível marítimo-portuário,
enquadra-se num termo geral, e mais amplo que é a segurança marítima, a qual se divide em
maritime safety e em maritime security.
A presente dissertação aborda as três principais vertentes que comportam o conceito de
maritime security. Neste sentido, são abordados os seus princípios legais, nomeadamente o Código
ISPS, assim como outros regulamentos que edificam a legal vigente, para uma atuação no âmbito da
maritime security. Posteriormente, analisar-se-ão, como estudo de caso, duas instalações portuárias
certificadas no âmbito do Código ISPS, nomeadamente no Porto de Lisboa e de Setúbal, o que
permite efetuar uma comparação das medidas de proteção em vigor em cada um dos portos.
No sentido de analisar a interação das autoridades neste âmbito, procedeu-se à análise de
dados dos últimos 6 anos, em matéria de segurança de pessoas, bens e crime marítimo na área de
jurisdição do Comando Local da Polícia Marítima de Lisboa e de Setúbal, sendo estes dados,
especialmente úteis e relevantes para aferição da tipologia criminal que ocorre mais frequentemente
nos portos, tendo em consideração a dimensão dos mesmos.
Desta forma, os casos de estudo das instalações portuárias e a análise dos dados nos dois
Comandos Locais da Polícia Marítima, juntamente com as conclusões que destas advêm, servirão
para acrescer ao conhecimento referente a todo o quadro da maritime security existente em
Portugal, contribuindo assim para uma efetiva sedimentação do seu contexto funcional e
operacional.
The sea is an especially relevant factor in the Portuguese economy, since 90% of commercial transactions abroad are made by sea. The peculiar geomorphology of Portugal, as well as its very wide maritime jurisdictional area, associated with the economic interest, reinforces the importance of the concept of maritime security, mainly because there is no economic development without security. Security at the maritime-port level fits into a general and broader term, maritime security, which is divided into maritime safety and maritime security. This dissertation addresses the three main aspects that comprise the concept of maritime security. In this sense, its legal principles are addressed, namely the ISPS Code, as well as other regulations that build the current law, for a performance within the scope of maritime security. Subsequently, two port facilities certified under the ISPS Code will be analysed, as a case study, namely in the Port of Lisbon and Setúbal, which allows a comparison of the security measures in place in both ports. In order to analyse the interaction of the authorities in this scope, data analysis of the last 6 years has been carried out, in terms of security of people, goods and maritime crime in the area of jurisdiction of the Local Command of the Maritime Police of Lisbon and Setúbal, which was especially useful and relevant for assessing the criminal typology that occurs most frequently in ports, taking into account their size. Therefore, the case studies of the port facilities and the analysis of the data in the two Local Commands of the Maritime Police, together with the conclusions that derive from them, will serve to add to the knowledge regarding the entire framework of maritime security existing in Portugal, thus contributing to an effective sedimentation of its functional and operational context.
