Abstract(s)
As redes terroristas internacionais, o narcotráfico e a imigração ilegal, aproveitam as facilidades decorrentes do processo de globalização. A sua prevenção e combate exigem uma combinação de meios militares, policiais e de informações, bem como uma ampla e profícua cooperação internacional. Tudo indica que o terrorismo internacional permaneça, durante os tempos vindouros, como a principal e mais séria ameaça contra as sociedades. Este tipo de ameaça, sobretudo se associada à utilização de armas de destruição maciça, configura cenários de elevadíssimo risco, que exigem o esforço global e concertado dos Estados, aonde o envolvimento das forças armadas (FFAA) se apresenta indispensável. Definir o seu papel, concretizar as condições que envolvem o seu emprego, balizar de forma clara a sua actuação e explicitar missões, responsabilidades e tarefas, visando a sua entrada em acção de forma oportuna e eficaz, reveste-se de uma extraordinária relevância e acuidade. Neste contexto, e sobretudo na ordem interna, para que as FFAA possam ser empregues eficazmente, afigura-se necessário que, ao nível político, sejam criadas as condições organizacionais e de cooperação interministerial, bem como todo o edifício legislativo correspondente. Ao nível militar propriamente dito, julga-se pertinente criar doutrina, conceber planos, ministrar formação e conduzir o treino, tendo em vista o emprego eficaz e coordenado dos meios e capacidades militares, neste combate.
O tema foi abordado no quadro mais vasto da segurança, no qual as linhas de separação entre a vertente interna e externa de defesa se desvanecem. Os compromissos internacionalmente assumidos no âmbito das alianças de que Portugal faz parte, o ordenamento jurídico e conceptual nacional, as orientações da UE e a doutrina NATO constituíram referências relevantes na elaboração deste estudo. As soluções encontradas por outros países, no que respeita ao emprego dos meios e capacidades militares neste contexto, foram igualmente objecto de reflexão e análise.
Inicialmente debruçámo-nos sobre a questão substantiva, tendo por finalidade inferir da importância do papel das FFAA na prevenção e combate a estas ameaças. Seguidamente, passámos à identificação das condições organizacionais, tanto no quadro global do Estado como na perspectiva interna das FFAA, que devem encontrar-se reunidas para que elas possam ser empregues eficazmente. Identificadas essas condições, reflectimos sobre a perspectiva legal, com o objectivo de averiguar se estão criados todos os mecanismos legais necessários ao emprego de forças militares neste tipo de operações, na ordem interna e externa. Por último, apresentámos conclusões e recomendações.
Efectivamente, para dar corpo à existência de uma capacidade nacional eficaz de prevenção e combate ao terrorismo internacional, ao narcotráfico e à imigração ilegal, torna-se necessário que, no âmbito específico do papel e empenhamento das FFAA, se promovam ajustamentos, adaptações e melhorias do quadro legal e organizacional, bem como de doutrina, de formação e de treino. Abstract: International terrorist networks, narcotraffic and illegal immigration take advantage of the globalization process. Its prevention and combat demand a combination of military, police and intelligence means, as well as a broad and efficient international cooperation. It seems that international terrorism will prevail in future times, as the main and most serious threat against societies. This kind of threat, especially if associated to the use of weapons of mass destruction will configure scenarios of great risk, which demand the global and agreed effort of the States, where the engagement of the Armed Forces presents itself essencial. Defining its role, materializing the conditions that involve its employment, clearly marking its action and fixing missions, responsibilities and tasks, aiming its entry in action in a timely and effective way is extraordinarily relevant and has great acuity. In this context, and especially internally, in order that the Armed Forces can be employed effectively, it is necessary that, at a political level, organizational and interministerial cooperation conditions are created, as well as all the legislation it requires.
At a military level, it seems pertinent to create doctrine, conceive plans, educate and conduct training, aiming to employ effectively the military capacities and means in this fight.
The theme was approached in the broadest sense of security, in which the traditional boundaries between the internal and external defense fade away. The internationally assumed commitments within the alliances that Portugal takes part in, the national concepts and laws related to this matter, the EU orientations and NATO doctrine constituted relevant references in the making of this study. The solutions found by other countries regarding the employment of the military capacities and means, in this context, were equally object of profound consideration and analysis.
Initially we analysed the substantive issue, having as a goal to infer the importance of the role of the Armed Forces in the prevention and combat of this type of threats. Next, we aimed to identify the organizational conditions, in the global framework of the State and in the internal perspective of the Armed Forces, which should be gathered, so that they can be employed effectively. Thereafter, we reflected over the legal perspective, having as a goal to inquire if all legal mechanisms necessary to the employment of military forces in this kind of operations, both internally and externally, are created. Lastly, we presented conclusions and recommendations.
In fact, to create an effective national capacity capable of prevention and combat to international terrorism, narcotraffic and illegal immigration, it becomes necessary that in the specific scope of the role and engagement of the Armed Forces, adjustments, adaptations and improvements of the legal and organizational framework are promoted, as well as of doctrine, education and training.
