A ocupação ilegal é um fenómeno universal, definido como a ação pela qual pessoas
ocupam imóveis sem possuir título que a autorize. Procurando assim, responder a razões de
carência material, no sentido de satisfazer a necessidade de habitação, ou assumir-se como
objetivo de fomentar ideologias ou mesmo como forma de luta contra políticas económicas
e sociais. Em Portugal, a ocupação ilegal é um desafio à ação policial, na medida em que a
resolução poderá assumir desfechos antagónicos na justa valoração do bem a salvaguardar,
seja na garantia do legítimo titular com o reaver do imóvel, ou no direito de quem o ocupa
na inviolabilidade do domicílio e da intimidade pessoal, por ter materializado o espaço
ocupado na sua habitação condigna. Assim, o presente estudo teve como propósito, por um
lado, demonstrar o estado da arte da ocupação ilegal através do enquadramento e análise
teórica das normas jurídicas positivas e das refências bibliográficas e, por outro lado, munir
os profissionais da Polícia de Segurança Pública de conhecimento e contributos a uma
correta ação policial, no desígnio de uma Polícia integral, humana, forte, coesa e ao serviço
do Cidadão.
Illegal occupation is a universal phenomenon, defined as the action by which people occupy properties without having a title that authorises it. Thus, it tries to respond to reasons of material need, in order to satisfy the need for housing, or it may be assumed as an objective to foment ideologies or even as a form of struggle against economic and social policies. In Portugal, illegal occupation is a challenge to police action, insofar as the resolution may assume antagonistic outcomes in the fair valuation of the asset to be safeguarded, either in the guarantee of the legitimate holder with the repossession of the property, or in the right of those who occupy it in the inviolability of the domicile and personal intimacy, for having converted the occupied space into a decent dwelling. Therefore, the purpose of this study was, on the one hand, to demonstrate the state of the art of illegal occupation through the theoretical framework and analysis of positive legal norms and bibliography, on the other hand, to provide to professionals of the Public Security Police knowledge and contributions for a correct police action, in the design of an integral, human, strong, cohesive Police force at the service of the Citizen.
