A identificação na Lei de Segurança Interna: redundância ou originalidade

dc.description.abstractA polícia constitui uma das atividades do Estado encarregues de produzir segurança, nomeadamente na prevenção de perigos e no auxílio à justiça penal. Para prosseguir essa missão, a polícia conta com as designadas medidas de polícia, instrumentos jurídicos que habilitam a intervenção policial mediante a verificação de determinados pressupostos. Entre essas medidas de polícia destaca-se o controlo de identidades humanas, comumente tratadas por identificações. Esta é uma medida de polícia elementar, suscetível de ser praticada em qualquer intervenção policial. A doutrina jurídico-policial é consensual no reconhecimento de duas modalidades de identificações: uma para fins preventivos, outra para fins de perseguição e repressão penal. Assim, enquanto a identificação prevista no Código de Processo Penal assume uma natureza repressiva, a identificação prevista na Lei de Segurança Interna deverá assumir uma natureza preventiva. No entanto, as identificações preventivas parecem ser ignoradas ou esquecidas pelo nosso efetivo policial. Inclusive, algumas vozes afirmam que a identificação na Lei de Segurança Interna constitui uma medida de polícia redundante que nada acrescenta à identificação prevista no Código de Processo Penal. Deste modo, afigura-se como propósito da presente investigação averiguar a redundância ou originalidade da identificação prevista na Lei de Segurança Interna. Dito por outras palavras, pretende-se, pois, determinar se no ordenamento jurídico português existe espaço para uma modalidade de identificação preventiva, de que forma a mesma se distancia da identificação processual-penal e indicar quais os seus limites.pt_PT
dc.description.abstractThe police is one of the activities of the State in charge of producing security, namely, in the prevention of dangers and in the aid of criminal justice. To carry out this mission, the police rely on the so-called police measures, legal instruments that enable police intervention by verifying certain assumptions. Among these police measures, the control of human identities stands out, commonly referred to as identifications. This is an elementary police measure, likely to be used in any police intervention. The doctrine of police law is consensual in recognizing two types of identification: one for preventive purposes, the other for pursuit and criminal repression. Thus, while the identification presente in the Criminal Procedure Code assumes a repressive nature, the identification provided for in the Internal Security Law should assume a preventive nature. However, preventive identifications seem to be ignored or forgotten by our police force. Some voices even claim that identification in the Internal Security Law is a redundant police measure that adds nothing to the identification presente in the Criminal Procedure Code. The purpose of this investigation is to ascertain the redundancy or originality of the identification provided in the Internal Security Law. In other words, the aim is therefore to determine whether there is space in the Portuguese legal system for a type of preventive identification, how it distances itself from criminal procedural identification and what are its limits.pt_PT
