Abstract(s)
O presente estudo teve como propósito analisar e avaliar a importância e influência
da Ética na PSP, bem como a importância do poder disciplinar.
Apresentando-se como um fundamento da própria conceção da missão da PSP, a
Ética representa simultaneamente um fim a atingir e modela o comportamento dos seus
profissionais, nascendo assim o conceito de ética policial.
A deontologia, apresentando-se como estratégia de imposição desta ética, resulta na
formulação de um conjunto de deveres, princípios e normas que norteiam a atividade
policial, necessitando do conteúdo sancionatório e repressivo do poder disciplinar para que
os mesmos se imponham.
A conclusão é que a Ética influi duplamente a PSP. Se a Ética detém um caráter
universal, fundado nos direitos humanos, por outro, tem um caráter pessoal, do ponto de
vista comportamental dos polícias. Estando obrigatoriamente presente a nível estratégico,
na definição da sua missão, ela é materializada a nível operacional pelos polícias no
quotidiano. Assim, a Ética não se afigura apenas como uma mera indicação prescritiva,
bem pelo contrário, ela tem uma aplicação prática.
Quanto ao poder disciplinar, ele é imprescindível numa instituição hierárquica
como a PSP, sendo através deste, que os deveres ganham coercividade, impondo uma
probidade institucional e pessoal.
The purpose of this study has been to assess and ascertain the relevance and influence of Ethics in the PSP, as well as the importance of disciplinary power. As a basis for the inception of the PSP’s mission, Ethics represents, simultaneously, a goal to be achieved and it shapes the behaviour of its professionals, bringing about the concept of police ethics. Presenting itself as a strategy for imposing this moral philosophy, deontology results in the shaping of a set of duties, principles and norms which guide police activity, and it calls for the sanctioning and repressive aspect of disciplinary power in order to ensure their assertion. It can be concluded that the PSP is dually influenced by Ethics. If Ethics holds a universal character based on human rights, it also carries a personal character from a behavioural point of view of the policemen and women. Considering that it is mandatorily present on a strategic level, in the outlining of its mission, it is daily materialised on an operational level by police officers. Therefore, Ethics does not appear to be a mere prescriptive indication; on the contrary, it carries a practical use. With respect to disciplinary power, it is crucial to a hierarchical institution such as the PSP, and it is through said power that duties gain coercivity, imposing a personal and institutional virtue.
