Abstract(s)
O presente Trabalho de Investigação Aplicada intitula-se: “A atuação da GNR na garantia dos direitos humanos” e tem como objetivo geral compreender a garantia dos direitos humanos através da atuação da GNR. Desta forma, surge a seguinte problemática: a atuação da GNR visa a garantia dos direitos humanos?
A metodologia empregue nesta investigação assenta nos métodos descritivo e inquisitivo e visa, com recurso à análise documental e a inquéritos por entrevista, desenvolver uma cadeia de raciocínio, tendo em vista a resposta a perguntas derivadas e concluindo com a resposta à pergunta de partida, dando privilégio a uma abordagem qualitativa.
Neste estudo são abordados, de um ponto de vista teórico, os temas de direitos humanos e da atividade policial exercida pela GNR, incluindo o controlo exercido sobre essa atividade. De seguida, é apresentada a metodologia utilizada na investigação e, ainda, a apresentação, análise e discussão dos resultados. Por fim, são expostas as conclusões, limitações e recomendações para investigações futuras.
Finalizada a investigação, concluímos que a atuação da GNR visa os direitos humanos. A atividade levada a cabo pela GNR é enquadrada pelos ordenamentos jurídicos nacional e internacional e contribui para que os cidadãos usufruam plenamente dos seus direitos. Sendo a face visível da força do Estado, os militares podem, em situações determinadas por Lei, fazer uso de meios coercivos, os quais se encontram limitados de forma a respeitarem princípios de necessidade, adequabilidade e proporcionalidade. Para além dos normativos legais existentes que orientam a conduta dos militares, há entidades externas à GNR, como os tribunais e a Inspeção-Geral da Administração Interna, que fiscalizam as ações executadas no âmbito das competências da GNR. Esse controlo contribui para que a atuação da GNR vise os direitos humanos.
This research, entitled: “GNR’s performance in the guarantee of human rights” and its general objective is to understand the guarantee of human rights by the GNR’s performance. As such, the following problem arises: is the GNR’s goal aimed at human rights? The methodology employed in this research is based on descriptive and inquisitive methods and aims at the development of a chain of reasoning, with recourse to documentary analysis and interview surveys, aiming at the answering of derived questions and concluding with the answer to the question of departure, giving privilege to a qualitive approach. In this study, from a theoretical point of view, the issues of human rights and police activity carried out by the GNR, including the existing control over this activity, are discussed. Next, the methodology used in the research is presented, as well as the presentation, analysis and discussion of the results. Finally, conclusions, limitations and recommendations for future investigations are presented. After the investigation, we conclude that the GNR's work is aimed at human rights. The activity carried out by the GNR is framed by national and international legal systems and contributes to the citizens' full enjoyment of their rights. Being the visible face of the State's force, the GNR’s policemen can, in situations determined by law, use coercive means, which are limited in order to respect principles of necessity, adequacy and proportionality. In addition to the existing legal regulations governing the conduct of the military, there are entities outside the GNR, such as the courts and the General Inspectorate of Internal Administration, which oversee the actions carried out within the scope of GNR's competencies. This control contributes to the GNR's work on human rights.
