Abstract(s)
Os Estados democráticos e de direito caracterizam-se sobretudo por ter uma Polícia ao serviço do povo e para o povo, sendo impensável, hoje em dia, uma sociedade democrática que não acompanha esta dinâmica. Angola procura, no pós guerra civil, não ficar aquém desse desenvolvimento que já se verifica até nalguns países irmãos da Comunidade dos Países de Língua Oficial Portuguesa.
Por este facto, e aliado à constante evolução socioeconómica, fruto do desenvolvimento humano e tecnológico, que o país tem vindo a registar, é necessário que o Estado esteja dotado de uma Polícia capaz de responder, preventiva e reactivamente, aos níveis da criminalidade que têm vindo a crescer cada vez mais, em especial nas grandes cidades.
A Constituição da República de 2010 é a primeira Constituição do país que faz referência sobre a polícia em Angola. A presente Dissertação tem, como objectivos, apresentar bases jurídico-policiais para auxiliar no desenvolvimento de uma possível teorização do Direito Policial de Angola, dando maior ênfase na caracterização do direito policial, no esclarecimento de quais as forças e serviços de segurança que contribuem para a manutenção da segurança nacional, quais as atribuições e competências que lhes são conferidas por lei; quais são as autoridades de polícia, como se distinguem das autoridades administrativas com poderes de polícia, bem como questões relativas à actividade de investigação criminal, nomeadamente uma análise do ponto de vista jurídico, no que concerne à criação de um serviço de investigação criminal na dependência directa do Ministério do Interior.
The democratic and lawful States define themselves by having their Police on the service of the people and for the people, being unthinkable nowadays, any democratic society that does not follow this standards. Angola is working, on the aftermath of the civil war, to not stay behind this development that is already noticeable in some countries of the Community of the Official Portuguese Speaking Countries. Because of this, and allied with the constant socioeconomic evolution, result of the human and technologic development the country has been registering, it's necessary that the State incorporates a Police force capable to respond, preventively and reactively, to the crime levels that have been rising, specialy in the major cities. The Republic Constitution of 2010 is the first Constitution of the country that makes reference to the police in Angola. The present dissertation has in its objectives, to present judicial support and police knowledge to help the development of a theorization in Police Law in Angola, giving more emphasis in portraying police law; in explaining wich security forces and services contribute for the maintenance of the nacional security; wich are their powers and capacities conferred by law; wich are the police authorities; how to distinguish administrative authorities with police powers; as well as questions regarding the criminal investigation activity, namely a judicial analysis concerning the creation of a criminal investigation service in the direct jurisdiction of the Interior Ministry.
