A dissertação consiste em um estudo acerca das polícias de Portugal e no Brasil.
Teve como escopo mergulhar, verticalmente, no estudo da segurança interna, e,
mais precisamente, adentrar na segurança pública e nos sistemas e modelos
policiais, ou seja, nas polícias, em ambos os países. A pesquisa teve como objetivo
principal investigar, especialmente, duas polícias de ordem pública, a Polícia de
Segurança Pública e a Polícia Militar (mais especificadamente, a Brigada Militar). O
estudo apresenta, notadamente, a competência legal da Polícia de Segurança
Pública e da Brigada Militar, quanto a investigação criminal conduzida por estas
polícias, face as Constituições e legislações vigentes. O trabalho utiliza-se da
análise das leis, e, no caso do Brasil, diante de controvérsias, lança-se mão de
doutrina e jurisprudência para demonstrar as competências dentro do subsistema de
investigação criminal. Ao final, a pesquisa apresenta um paralelo entre as duas
polícias de ordem pública quanto a investigação criminal, e, destas em relação a
definição de polícia integral e/ou de “ciclo completo de polícia”.
The dissertation is a study about the police forces in Portugal and Brazil. Its goal was to deeply study the internal security and, more precisely, the public security, police systems and models in both countries. The main goal of this research was to investigate, especially two police forces for the public order, the Public Security Police and the Military Police (more specifically, the Military Brigade. As far as crime investigation is concerned, this study notably presents the legal competence of the Public Security Police and the Military Police in conformity with the Constitutions and current legislations in force. The work was based on the analysis of laws - although in the case of Brazil due to several controversies, it was based on the doctrine and jurisprudence - to demonstrate the skills within the subsystem of the crime investigation. At the end, the research presents a parallel between the two police forces of public order regarding crime investigation and the definition of integral police and / or “complete cycle of police”.
