Em Portugal, a delegação legal em entidades privadas de funções asseguradas previamente pela Polícia tornou-se uma realidade no caso das revistas de prevenção e segurança intrusivas, no controlo de acesso a recintos desportivos – passaram, pela Lei n.º 46/2019, de 8 de julho, a poder ser realizadas por assistentes de recinto desportivo. É sobre a privatização destas revistas que a presente investigação incide, tendo-se como foco do estudo a admissibilidade da delegação desta tarefa em entidades privadas.
A investigação tem como objetivo geral analisar as alterações legislativas que delegaram, legalmente, a tarefa de realização de revistas intrusivas no controlo de acesso a recintos desportivos a entidades privadas. Pretende-se, ainda, caraterizar o papel a assumir pela Polícia, sob a forma de supervisão, nesta transferência de poderes. Em termos metodológicos, este estudo recorre às análises legal, jurisprudencial e doutrinária, por um lado. Por outro lado, socorre-se da técnica de entrevista (realizada pelo autor a 17 especialistas na área) e de análise de conteúdo dessas mesmas entrevistas. Os resultados incidirão sobre a verificação do cumprimento dos requisitos de constitucionalidade da delegação legal das revistas intrusivas em assistentes de recinto desportivo e sobre o papel admitido para as forças de segurança nesta delegação. Pretende-se, com isso, concluir se, face ao ordenamento jurídico-constitucional português, as revistas de prevenção e segurança intrusivas deviam ser prosseguidas unicamente pela Polícia
In Portugal, the legal delegation into private entities of functions ensured previously by the Police became a reality in the case of safety and prevention body searches, in the access to sport events – they can now be carried out by stewards, by the Law n.º 46/2019, 8th july. The current investigation deals with the privatization of these body searches, focusing on the admissibility of this assignment delegation into private entities. The investigation has as its general objective to analyze legislative changes that have legally delegated into private security the assignment of performing intrusive body searches in the access to sport events. It is also intended to characterize the role that Police should assume in this powers transference, in the form of supervision. In methodological terms, this study uses, on the one hand, legal, jurisprudential and doctrinaire analyzes. On the other hand, it resorts to the interview technique (performed to 17 experts in the field by the investigator) and to content analyze of these interviews. The results will focus on verifying compliance with the constitutionality requirements of the legal delegation of intrusive body searches into stewards, and on the role of security forces in this delegation. With this, it is intended to conclude if intrusive safety and prevention body searches should be prosecuted only by the Police, in light of the Portuguese legal-constitutional conventions.
