A contratação pública, ligada a uma nova abordagem da organização e funcionamento dos
Estados, fortemente impulsionada pela União Europeia, ganha relevância em Portugal no
final do século XX e início do século XXI, mormente com a aprovação, em 2008, do Código
dos Contratos Públicos e, em 2017, com a introdução de reformas muito substanciais, onde
se insere a criação do gestor do contrato (GC), figura que concorre, preponderantemente,
para o desígnio europeu da gestão profissional dos contratos públicos, alinhado com os
princípios da eficiência e da economicidade orientados para os resultados e para a
maximização do interesse público.
O GC assume um papel relevante no seio da execução contratual da Polícia de Segurança
Pública (PSP), definindo-se como objetivos gerais do presente estudo a identificação das
implicações formais subjacentes à figura do GC na atividade contratual pública, a
averiguação da observância de tais formalismos nas contratualizações da PSP e a avaliação
do desempenho material do GC na execução dos contratos.
O problema da presente investigação consiste em aferir se, no quadro legal vigente, o GC na
PSP reúne os requisitos para o bom desempenho da função. Para o efeito, foi aplicado um
inquérito por questionário a profissionais designados GC, tendo os resultados evidenciado a
necessidade de promoção de medidas que concorram para o incremento de valor em aspetos
relevantes do desempenho da função, mormente nos domínios da formação e da capacitação
técnica.
Public procurement, linked to a new approach to the organisation and functioning of states, strongly promoted by the European Union, gained importance in Portugal at the end of the 20th century and the beginning of the 21st century, especially with the approval of the Public Contracts Code in 2008 and, in 2017, with the introduction of very substantial reforms, including the creation of the contract manager (CG), a figure who contributes preponderantly to the European goal of professional management of public contracts, in line with the principles of efficiency and cost-effectiveness geared towards results and maximising the public interest. The CG plays an important role within the contractual execution of the Public Security Police (PSP), and the general objectives of this study are to identify the formal implications underlying the figure of the CG in public contractual activity, to ascertain whether these formalities are observed in PSP contractualisations and to assess the material performance of the CG in the execution of contracts. The problem of this research is to assess whether, within the current legal framework, the PSP's CG fulfils the requirements for the proper performance of the role. To this end, a questionnaire survey was administered to professionals designated as CG, and the results highlighted the need to promote measures that contribute to increasing value in relevant aspects of the performance of the function, especially in the areas of training and technical capacity building.
