Abstract(s)
O Estado consubstancia um conjunto de pessoas politicamente organizadas que comporta as
instituições que se destinam a garantir a boa convivência entre os cidadãos. Dentro das
funções administrativas do Estado, as Forças de segurança (FS) representam uma das
principais instituições, cuja função é garantir e proteger todos os cidadãos. Deste forma, no
que concerne ao recurso a meios coercivos nas atividades das FS, estes devem ser aplicados
com a observância à lei e nunca além do estritamente necessário e, as FS devem adaptar as
atuações aos modelos ajustados à atualidade. Neste sentido, e considerando que o trabalho
das FS assume uma extrema importância para a aplicação da lei, é fundamental serem
adotadas normas e regulamentos sobre o uso de meios coercivos por parte dos seus efetivos.
Centrando-nos no panorama securitário guineense, entendemos a pertinência que a matéria
do recurso aos meios coercivos acarreta para agentes das forças de segurança e para a
sociedade em geral. Desta forma, o nosso estudo incidiu sobre o uso de meios coercivos nas
FS da Guiné-Bissau, e teve como objetivo geral centrar-se, por um lado, na necessidade de
as FS guineenses apoiarem-se num quadro legislativo fundamental e, por outro lado, na
importância de padronizar as atuações dos seus agentes nomeadamente através da criação e
implementação de normas de execução permanentes. Com base num estudo de natureza
qualitativa, percorremos à realização de entrevistas a oficiais das duas FS guineenses,
procurando conhecer aspetos das realidades operacionais dessas duas forças, as quais foram
sujeitas a análise de conteúdo.
The State is a politically organized group of people that includes institutions intended to ensure that citizens live together in harmony. Within the administrative functions of the State, the Security Forces (FS) represent one of the main institutions, whose function is to guarantee and protect all citizens. Thus, in what concerns the use of coercive means in the activities of the FS, these must be applied in compliance with the law and never beyond what is strictly necessary, and the FS must adapt their actions to the models adjusted to the present time. In this sense, and considering that the work of the FS is extremely important for law enforcement, it is essential to adopt rules and regulations on the use of coercive means by its personnel. Focusing on the Guinean security scenario, we understand the relevance that the issue of the use of coercive means has for agents of the security forces and for society in general. Thus, our study focused on the use of coercive means in the Guinea-Bissau FS, and its general objective was to focus, on the one hand, on the need for the Guinea-Bissau FS to be supported by a fundamental legislative framework and, on the other hand, on the importance of standardizing the actions of its agents, namely through the creation and implementation of permanent implementing rules. Based on a qualitative study, we conducted interviews with officers of the two Bissau-Guinean security forces, in an attempt to understand aspects of the operational realities of these two forces, which were subjected to content analysis.
