Abstract(s)
A presente dissertação de mestrado aborda o funcionamento da Autoridade Marítima Nacional (AMN) e da Direção-Geral da Autoridade Marítima (DGAM), tomando em especial atenção a sua relação com a estrutura da própria Marinha Portuguesa (MP).
A AMN tem, ao longo dos últimos anos, assumido uma relevância maior para o Estado Português e para a sua capacidade de exercer a autoridade do estado no mar. Muitas vezes, a AMN surge através dos diferentes órgãos e serviços a esta associados, como é o caso da Polícia Marítima (PM), os capitães dos portos, o Instituto de Socorros a Náufragos (ISN), entre outros. Considera-se pertinente analisar a forma como toda esta estrutura interage entre si e com as entidades exteriores e de que forma é que cumpre com as responsabilidades e missões que lhe são atribuídas na lei, pelo Estado Português.
Este trabalho inicia-se com uma breve análise da legislação aplicável ao tema, para efeitos de enquadramento normativo do sistema de ação e da estrutura da AMN – DGAM. Posteriormente, através de entrevistas a diversas entidades relevantes, formula-se uma análise das dificuldades sentidas ao longo da estrutura, nos diversos níveis de ação, bem como das propostas de mudança ouvidas ao longo dos contatos efetuados.
Esta dissertação termina com uma análise do futuro da AMN e da sua contribuição para o Estado Português, concluindo que a AMN deve assumir, progressivamente, o seu papel como entidade-chave no Sistema de Autoridade Marítima (SAM), capacitada para exercer comando e controlo efetivo sobre os seus próprios meios, ambicionando o reforço de recursos humanos e materiais, e munida de um centro que apoie os atores, no terreno de operações, a efetuar a coordenação com as demais entidades que fazem parte do SAM, fomentando ainda a prevenção de situações de emergência.
The present master’s degree dissertation addresses the operation of the National Maritime Authority (AMN) and the Maritime Authority’s General Directorate (DGAM), with special attention to their relationship with the Portuguese Navy’s structure. Over the years, the AMN has assumed an increasing relevance for the Portuguese State and its capability of exercising authority at sea. Often, the AMN is represented through its various associated services and institutions, such as the Maritime Police (PM), the harbor captains, the Shipwrecked Rescue Institute (ISN), among others. It is relevant to analyze how this entire structure interacts internally and with external entities, and how it fulfills its responsabilities and missions, legally assigned by the Portuguese State. This work starts with a brief analysis of the legislation applicable to the topic, in order to provide a normative framework for the AMN – DGAM structure’s and action system. Afterwards, based on interviews with various relevant entities, the study analyzes the difficulties encountered throughout the structure, in the diverse levels of action, as well as proposed changes, identified by the same entities. This dissertation ends with an analysis of the future of AMN and its contribution to the Portuguese State, concluding that AMN should assume, progressively, its role as a key entity in the Maritime Authority System (SAM), empowered to exercise command and control over its own assets, ambitioning reinforcement in its human and material resources, and equipped with a center that supports the field operatives in carrying out the coordination with the remaining entities that belong to SAM, further promoting prevention of emergency situations.
