No presente estudo fez-se uma reflexão sobre o papel da testemunha no processo penal, nomeadamente acerca das medidas que devem ser aplicadas com vista a garantir a sua
proteção e relativamente a procedimentos que devem orientar a produção de prova testemunhal. Tratou-se de um estudo eminentemente prático, almejando-se que o mesmo possa indicar boas práticas a seguir, as quais potenciem o respeito pela Lei, a dignidade da testemunha, a sua proteção e a eficácia do processo. Obtiveram-se contributos de especialistas de diferentes entidades com responsabilidade na matéria, oriundos de todos os distritos e regiões autónomas do país, nomeadamente Juízes, Procuradores da República, Polícias e Técnicos de Apoio à Vítima, com vista a fortalecer as conclusões alcançadas. Foi objetivo desta investigação fornecer aos operadores do direito, que no seu
quotidiano lidem com testemunhas, mais uma ferramenta de trabalho que os auxilie na sua função, bem como recolher evidências que possam indicar ao legislador qual o caminho que deve ser seguido nesta área do conhecimento.
This study reflected on the role of witnesses in criminal proceedings, specifically regarding the measures that should be implemented to ensure their protection and the procedures that should guide the production of testimonial evidence. This was a highly practical study, aiming to indicate best practices that promote respect for the law, the dignity of witnesses, their protection, and the effectiveness of the process. Contributions were obtained from experts from various entities responsible for the matter, from all regions of the country, including judges, public prosecutors, police officers, and victim support technicians, to strengthen the conclusions reached. The objective of this research was to provide legal practitioners who deal with witnesses in their daily lives with another tool to assist them in their work, as well as to gather evidence that can indicate the path that legislators should follow in this area of knowledge.
