| dc.description.abstract | O tema deste artigo insere-se num dos institutos mais relevantes dos meios de prova - a testemunhal. Em inúmeras investigações o depoimento indireto, é a “pedra de toque” com a qual os Órgãos de Polícia Criminal (OPC) obtêm a notícia do crime de difícil perceção, como por exemplo a violência doméstica, ou em tipos de criminalidade mais “organizada e profissionalizada” como o lenocínio ou qualquer uma das modalidades de tráfico com alguma dimensão. Considerando a controvérsia que o tema tem gerado, é objetivo deste trabalho fazer uma análise do instituto do Depoimento Indireto, por forma a aferir da sua admissibilidade e limites, independentemente da sua fonte e do momento em que se “ouviu-dizer”. Terminaremos com uma breve alusão aos depoimentos indiretos por parte dos OPC, legalmente tratados como Conversas Informais. Para este efeito, o presente estudo de natureza teórica incidirá essencialmente na revisão bibliográfica, análise de legislação, doutrina e também jurisprudência, por forma a corroborar o conhecimento relativo a esta prova e ao seu regime, pelo que é intenção do autor apresentar os diversos focos que incidem sobre um único, ou mesmo problema, o “que se ouviu dizer” ou vulgarmente designado o “diz-que- disse”. | |
| dc.description.abstract | The subject of this paper is part of one of the most relevant means of proof/evidence the testimonial. In numerous investigations, indirect testimony is the touchstone with which the Criminal Police Agencies obtain the news of crimes of difficult perception, such as domestic violence, or in more “organised and professionalised” types of crime, pimping and any other ways of trafficking of some dimension. Considering the controversy that the theme has generated, this work aims to make an analysis of the institute of Indirect Testimony, in order to assess its admissibility and limits, regardless of its source and the moment when it was heard say. We will end with a brief allusion to the indirect testimonies by the Criminal Police Agencies, which are legally treated as Informal Conversations. For this purpose the present study of a theoretical nature will essentially focus on the literature review, analysis of legislation, doctrine and also jurisprudence, in order to corroborate the knowledge related to evidence and its regime. It is the intention of the author to present the different perspectives that focus on a single problem, commonly known as the hearsay. | |
