Abstract(s)
É preciso ter em atenção que a presente dissertação de mestrado, tem como
pressuposto o facto do Malware, atualmente, não puder ser aplicado pelos
agentes encobertos, nem de outro modo, durante a investigação criminal. Esta
possibilidade não é equacionada visto que no nosso ordenamento jurídico não
existe nenhuma abertura para que se possa utilizar o Malware como meio de
obtenção de prova, quer seja pela interpretação de normas, nomeadamente,
aquelas que encontramos na LC, quer pela aplicação expressa doMalware, algo
que não existe, nos dias de hoje.
A partir desta ideia, entendemos que deve ser feita uma alteração legislativa,
no futuro próximo, tal como será elencado num dos capítulos e ainda a
possibilidade de conciliar dois meios ocultos de obtenção de prova, como é o
caso das ações encobertas em ambiente digital e o Malware.
It should be noted that this master's dissertation is based on the assumption that Malware cannot currently be used by undercover agents or in any other way dur ing a criminal investigation. This possibility is not considered because in our legal system there is no opening for Malware to be used as a covert means of obtaining evidence, either through the interpretation of existing rules, namely those found in the LC, or through the express application of Malware, something that does not exist to this day. Based on this basic idea, we believe that a legislative change should be made in the near future, as will be listed in one of the chapters, as well as the possibility of reconciling two hidden means of obtaining evidence, such as covert actions in the digital environment and Malware.
