Num tempo fortemente marcado pela globalização sobressaem, cada vez mais, novos e complexos desafios securitários. Tal realidade exige que os operadores judiciários recorram a instrumentos processuais aptos a corresponder perante múltiplas expressões de criminalidade, recomendando, por isso, especial atenção ao contributo da prova pericial no apoio à investigação criminal. O presente trabalho debruça-se sobre a intervenção da autoridade de polícia criminal (APC) no domínio da perícia processual penal, designadamente por se tratar de um meio de prova assente em metodologia científica e, por isso, sobremaneira relevante para a descoberta da verdade material e realização de justiça. Neste contexto, escalpelizaram-se os moldes em que a APC vem prosseguindo a respetiva missão neste domínio, evidenciando-se as potencialidades e constrangimentos detetados, bem como, eventuais soluções destinadas à sistematização deste mecanismo processual ao serviço de uma investigação criminal respeitadora dos direitos fundamentais e garantias processuais dos cidadãos. Do estudo efetuado conclui-se a necessidade de reajustamento da legislação inerente à intervenção da APC no âmbito da perícia processual penal, por forma a clarificar, uniformizar e operacionalizar a atuação deste operador judiciário de acordo com as necessidades de uma investigação criminal moderna e em consonância com os princípios estruturantes do Estado de direito democrático.
In an era strongly marked by globalization, new and complex security challenges are increasingly emerging. This reality requires judicial actors to resort to procedural instruments capable of addressing the multiple manifestations of crime, thereby underscoring the importance of expert evidence in supporting criminal investigations. This paper focuses on the role of the criminal police authority in the field of criminal procedural expertise, particularly because it constitutes a means of evidence grounded in scientific methodology and is therefore highly relevant to the discovery of material truth and the pursuit of justice. In this context, the study examines how the criminal police authority has been fulfilling its mission in this area, highlighting both the potential and the constraints identified, as well as possible solutions for systematizing this procedural mechanism in the service of criminal investigations that respect citizens’ fundamental rights and procedural safeguards. The study concludes that there is a need to revise the legislation governing the criminal police authority intervention in the field of criminal procedural expertise, in order to clarify, standardize, and operationalize the actions of this judicial actor in accordance with the demands of modern criminal investigations and the fundamental principles of the democratic rule of law.
