O Sistema de Autoridade Aeronáutica é o instrumento previsto na lei para reprimir
actos ilícitos e promover a segurança da aviação civil em Portugal no quadro da segurança
interna. Volvidos mais de 20 anos após a criação da Lei de Segurança Interna (Lei 20/87
de 12 de Junho), posteriormente alterada pela Lei 8/91, não foi regulamentado o Sistema
de Autoridade Aeronáutica.
No actual contexto internacional de segurança e defesa a segurança da aviação civil
concorre sobremaneira para a segurança interna. A utilização de aeronaves civis ao serviço
de actividades ilegais, ou veiculadas para perpetrar ataques a zonas populacionais e pontos
de elevado valor estratégico, representa uma ameaça à segurança das populações e à
prosperidade das sociedades.
A segurança da aviação civil assume três vertentes – a bordo das aeronaves, nas
instalações aeroportuárias e no espaço aéreo. Para garantir a segurança do espaço aéreo são
necessários meios como sistemas de armas e radares e uma estrutura de comando e
controlo que só as forças militares possuem.
Pretende-se que o Sistema de Autoridade Aeronáutica seja dotado das valências
necessárias para prevenir e reprimir a prática de actos de interferência ilegal contra a
aviação civil, numa altura em que as organizações internacionais intensificam esforços no
combate ao terrorismo. Abstract: The Aeronautical Authority System is the available tool in the law to suppress
unlawful acts and promote the safety of civil aviation in Portugal in the framework of
internal security. More than 20 years after the creation of the Internal Security Act (Law
20/87 of 12 June), subsequently amended by Law 8 / 91, the Aeronautical Authority
System is not yet regulated.
In the current international context of security and defence the security of civil
aviation strongly concurs for the internal security. The use of civil aircraft engaged in
illegal activities, or as an instrument to attack crowded areas and strategic high value
targets, represents a threat to people security and the prosperity of the societies.
The civil aviation security assumes three parts - on board the aircraft, at the airport
installations and at the airspace. To ensure the airspace security, resources such as weapons
systems, radars and a command and control structure are needed. Those are typically
military forces equipment.
It is intended that the Aeronautical Authority System shall be able to prevent and
suppress the practice of acts of unlawful interference against civil aviation, at a time when
international organizations are intensifying efforts in combating terrorism.
