Este estudo analisou a reestruturação institucional da gestão imigratória em Portugal, com foco na extinção do Serviço de Estrangeiros e Fronteiras e a criação da Unidade Nacional de Estrangeiros e Fronteiras transferindo para a Polícia de Segurança Pública competências cruciais no âmbito do controlo fronteiriço e fiscalização da entrada e permanência de cidadãos estrangeiros em território nacional. Analisou-se o regime jurídico que estabelece dois procedimentos para o afastamento de cidadãos estrangeiros que entrem ou permaneçam ilegalmente em território nacional, conforme previsto nos artigos 138.º e 146.º da Lei n.º 23/2007, de 4 de julho: a notificação para abandono voluntário ou a detenção administrativa. Defendeu-se que a notificação deve constituir a regra, reservando-se a detenção para situações excecionais, mediante critérios de necessidade, proporcionalidade e legalidade. Esclareceu-se a distinção conceptual entre “irregularidade”, enquanto ausência de formalismo administrativo e de “ilegalidade”, como violação de normas legais, parâmetros que se constituem como essenciais para evitar estigmatização e arbitrariedade. Propõe-se a uniformização de critérios operacionais para os agentes policiais, com base em procedimentos claros, objetivos, formação especializada e respeito pelos direitos fundamentais, bem como a adoção de uma abordagem humanista, legal e eficaz na gestão da imigração.
This study analysed the institutional restructuring of immigration management in Portugal, focusing on the abolition of the Foreigners and Borders Service and the creation of the National Foreigners and Borders Unit, transferring crucial powers in the area of border control and supervision of the entry and stay of foreign citizens in national territory to the Public Security Police. The legal regime establishing two procedures for the removal of foreign citizens who enter or remain illegally in national territory, as provided for in Articles 138 and 146 of Law No. 23/2007 of July 4, was analysed: notification for voluntary departure or administrative detention. It was argued that notification should be the rule, with detention reserved for exceptional situations, based on criteria of necessity, proportionality, and legality. The conceptual distinction between “irregularity,” as the absence of administrative formalities, and “illegality,” as a violation of legal norms, was clarified, as these parameters are essential to avoid stigmatization and arbitrariness. It is proposed that operational criteria for police officers be standardized, based on clear, objective procedures, specialized training, and respect for fundamental rights, as well as the adoption of a humanistic, legal, and effective approach to immigration management.
