| dc.description.abstract | A existência de conflitos entre indivíduos é uma constante verificada ao longo da História Humana. Os Estados Modernos perante a possibilidade da violência existente fazer perigar interesses colectivos, fez com que surgisse organismo estatal dotado de poderes coercivos, a POLÍCIA. Portugal, como Estado de Direito Democrático, e inerentemente defensor dos direitos liberdades e garantias pessoais, atribuiu constitucionalmente à Polícia a função de defender a legalidade democrática, garantir a segurança interna e os direitos dos cidadãos. Contudo, actualmente esta função é enquadrada e influenciada por diversos diplomas legais nacionais e internacionais que limitam a actividade policial. A Sociedade também se revela no presente como um factor cada vez mais crítico e não pactuante com excessos de força. Desta forma, cria-se uma conjectura de difícil resolução, uma vez que coloca em confronto a eficácia policial perante a necessidade de garantir os direitos pessoais legalmente constituídos. Desta forma, a Guarda Nacional Republicana perante a urgência de criar um equilíbrio entre a eficácia policial e o respeito pelos direitos fundamentais, aplicou armas de baixo índice letal ao seu dispositivo. Este estudo incide sobre o armamento de baixo índice letal e a sua aplicação operacional, definindo como objectivo principal verificar se a sua aplicação se traduz como uma mais-valia para o serviço policial. Este trabalho é composto por duas partes estruturantes essenciais, em que a primeira se prende com uma abordagem teórica e conceptual com vista a um enquadramento, que servirá de base à segunda parte, onde será explanado todo o trabalho de campo, bem como os resultados obtidos e as respectivas conclusões e recomendações. Metodologicamente a parte teórica baseou-se numa análise documental, na parte prática recorreu-se à realização de entrevistas e inquéritos a amostras diferentes, com o intuito de obter uma percepção mais alargada sobre as Armas de Baixo Índice Letal na Guarda Nacional Republicana. Chegou-se à conclusão que este tipo de armamento se constitui como uma maisvalia para o serviço policial ao potenciar o respeito pelos direitos, liberdades e garantias ao mesmo tempo que facilita a intervenção policial. Propõe-se que no futuro seja elaborado diploma regulador do recurso às Armas de Baixo Índice Letal e que se alargue a possibilidade de utilização de algum deste armamento a todo dispositivo territorial. | por |
| dc.description.abstract | Abstract The existence of conflicts between individuals is a constant throughout Human History. The Modern States, faced with the possibility that the existing violence might become a threat to the collective interests, have created a governmental agency endowed with coercive powers, the Police. Portugal, as a democratic state and a guardian of individual rights, liberties and guarantees, has constitutionally assigned to the police the function of ensuring democratic legality, internal security and the rights of citizens. However, at present, this function is framed and influenced by several national and international legal instruments that bound the police activity. The society has also become more and more critical and non covenant with excessive strength. All this creates a status difficult to resolve, since it brings police effectiveness against the need to ensure the legally constituted personal rights. Thus, the Guarda Nacional Republicana before the urgency of creating a balance between the police effectiveness and the respect for fundamental rights, introduced lesslethal weapons. This research focuses on less-lethal armament and its operational implementation. Our main goal is to verify if its use is really worth for the police service. This work is divided into two essential structuring parts: the first is concerned with a theoretical and conceptual approach in order to provide the basis for the second part where all the field work will be explained as well as the results obtained, the conclusions and recommendations. Methodologically, the theoretical part was based on the analysis of documents, while on the practical part we have implemented interviews and surveys in order to get a broader insight about the use of low-lethal weapons by Guarda Nacional Republicana. We have reached the conclusion that weapons of this kind are constituted as an asset for the police service to enhance respect for the rights, freedoms and guarantees at the same time it enables the police intervention. It is proposed that in the future be prepared a decree regulating the terms of use of less-lethal weapons and to extend the possibility of using some of this devices at all territorial units. | por |
