A condução de veículo sob influência de substâncias psicotrópicas representa um problema
complexo para a segurança rodoviária, desde logo pela diversidade de substâncias com
capacidade de afetar negativamente a condução. Nos últimos anos, a percentagem de
vítimas mortais em acidentes rodoviários envolvendo substâncias psicotrópicas aumentou
em quase todos os países europeus, sendo que em Portugal verificou-se uma tendência
crescente da percentagem de condutores mortos e de condutores fiscalizados com pelo
menos uma substância psicotrópica. Este trabalho analisou os efeitos e os riscos associados
à condução sob influência de substâncias psicotrópicas e os diferentes enquadramentos
jurídicos e procedimentos de fiscalização adotados nos diversos países. Neste âmbito,
verificou-se a importância de se alterar o paradigma da condução sob influência de
substâncias psicotrópicas em Portugal, nomeadamente no que respeita à diferenciação
entre o ilícito criminal e a contraordenação, à semelhança do que ocorre na condução sob
influência de álcool, e à adoção da saliva no exame pericial, substituindo a recolha
sanguínea, de forma a permitir uma simplificação dos procedimentos de fiscalização. O
presente trabalho destacou ainda as principais implicações e desafios destas alterações para
a Polícia de Segurança Pública.
Driving a vehicle under the influence of psychotropic substances represents a complex problem for road safety, firstly due to the diversity of substances with the capacity to negatively affect driving. In recent years, the percentage of fatalities in road accidents involving the use of psychotropic substances has increased in almost all European countries. In Portugal, as well, there has been a trend of increasing percentage of drivers’ casualties and instances of drivers under the influence of at least one psychotropic substance who have been controlled at police checkpoints. This study focused on the effects and risks associated with driving under the influence of psychotropic substances and the different legal frameworks and controlling procedures adopted in different countries. In this context, it was pointed out the importance of changing the paradigm of driving under the influence of psychotropic substances in Portugal, namely by distinguishing between a criminal offense and an administrative offence, similarly to what happens in driving under the influence of alcohol, as well as the possibility of the adoption of collection of saliva for forensic examination instead of blood collection. This new approach would allow the simplification of controlling procedures. The study also highlighted the main implications and challenges resulting from these changes for the Public Security Police.
