Abstract(s)
O presente estudo teve como objetivo desenvolver conhecimento que permitisse responder
de que forma estão ou poderão vir a ser cumpridas na prática as medidas de interdição de
acesso a recintos desportivos. Percorrendo a evolução histórica do aparecimento destas
medidas, em particular no país onde têm maior impacto e em Portugal, e analisando
literatura existente, foi-nos possível concluir que o nosso regime legal está adaptado às
necessidades e que tem margem para acolher alguns mecanismos que possam tornar o
controlo de acessos aos eventos desportivos totalmente eficaz. Apesar do curto período de
funcionamento pleno do lado relativo à aplicação das medidas, prévio ao nosso problema,
tem-se demonstrado uma capacidade de evolução. A aplicação prática tem demonstrado ser
muito dependente do conhecimento pessoal dos polícias, no entanto, há disponibilidade de
mecanismos para melhorar essa tarefa. Para além do controlo e impedimento de acesso, há
margem para, numa perspetiva multidisciplinar, trabalhar na dissuasão de comportamentos,
também na sua vertente positiva, criando uma cultura de respeito e segurança dentro dos
recintos desportivos.
The present study aimed to develop knowledge that would allow answering how the banning orders to sporting events are or may come to be fulfilled in practice. Going through the historical evolution of the appearance of these measures, particularly in the country where they have greater impact and in Portugal, and analysing existing literature, it was possible for us to conclude that our legal regime is adapted to the needs and that it has room to accommodate some mechanisms that may make the access control to sporting events fully effective. Despite the short period of full operation of the enforcement side of the measures, prior to our problem, it has demonstrated a capacity for evolution. The practical application has shown to be very dependent on the personal knowledge of police officers, however, there is availability of mechanisms to improve this task. Besides the control and prevention of access, there is room, in a multidisciplinary perspective, to work on the dissuasion of behaviours, also in its positive side, creating a culture of respect and safety inside sports venues.
