As profissões jurídicas e a (Re) organização judiciária: o estudo de caso dos oficiais de justiça

| dc.description.abstract | Em Portugal, ao longo das últimas décadas, a organização dos tribunais judiciais de comarca tem sofrido diversas alterações e, consequentemente, as profissões enquadradas no sistema judicial também. O objeto do presente estudo está balizado nas reformas do sistema judicial a partir da revolução de 1974, pois é a partir dessa altura que faz sentido interrogarmos “Qual o impacto das reformas do judiciário na profissão oficial de justiça?”. Já vários autores estudaram o tema da (re) organização do judiciário, alguns deles encontram-se referenciados ao longo deste ensaio pela pertinência das suas teorias para a presente investigação, no entanto muito ficou por dizer acerca da eficiência da justiça e dos seus profissionais. Ao analisarmos os autores referenciados e os seus estudos sentimos que existe uma negligência quanto ao impacto das reformas nos operadores da justiça, sobretudo quanto à carreira de oficial de justiça. No seguimento deste raciocínio, optamos por estudar o caso dos oficiais de justiça do Tribunal de Comarca de Santa Maria da Feira, distrito de Aveiro, à luz da sociologia, por motivos que serão esclarecidos durante a investigação, mas que se devem essencialmente à experiência de campo da investigadora. Assim, foram realizados alguns inquéritos por entrevista a diferentes atores da justiça, na busca de uma representação profissional dos oficias de justiça e de uma representação da organização judiciária quanto à eficiência do sistema. Através da análise dos dados obtidos foi possível verificar que, embora os inquiridos considerem a profissão oficial de justiça como importante e essencial ao bom funcionamento dos tribunais, a perceção atual acerca da profissão não é a mais positiva pelos constantes cortes e congelamentos nas carreiras e pelas sucessivas mudanças no funcionamento e organização dos tribunais. | pt_PT |
| dc.description.abstract | In Portugal, along the last decades, the judicial court organization has been suffering several modifications and, consequently, the legal professions also. The object of the present study is marked out in judicial reforms since revolution of 1974, because is when make sense asking “What is the impact the judiciary reforms in bailiff profession?”. Several authors already studied the subject of judicial (re) organization, some of them are referencing along this text for the relevance of his theories for the present investigation, however a lot of things stayed to say about the efficiency of the justice and of his professionals. When we analyse this studies we feel some neglience about reforms impact on justice operators, especially as for the bailiff career. For this reason, we opt to study the case of bailiffs of the Santa Maria da Feira Judicial Court, district of Aveiro, to the light of the sociology, for reasons that will be explained during the investigation, but essentially for the investigator field experience. So, we did some interviews to differenr actors of the justice, in the search of a professional representation of the bailiffs and a representation of the judicial organization as for the efficiency of the system. Through the data analysis it was possible check that, though the interviewed ones consider the bailiff profession as important and essential to the good functioning of the courts, current perception about this profession is not the most positive because the cuts in careers are constants and because the changes in organization sistem of courts are also constants. | pt_PT |
