A presente dissertação versa sobre a importância da Avaliação Multidimensional
no Regime Jurídico do Maior Acompanhado, introduzido pela Lei n.º 49/2018 de 14 de
agosto, que revogou o regime da Interdição e Inabilitação. A compreensão das
necessidades de cada indivíduo em concreto torna-se basilar para combater as medidas
ditas “amplas” do antigo regime. A promoção da capacidade que o indivíduo ainda detém,
embora de certo modo condicionada, é a matriz do novo Regime Jurídico. O
envelhecimento como forma de limitação da capacidade não implica necessariamente
uma medida restritiva ou limitadora da liberdade da pessoa. Assim, impera na aplicação
da medida de acompanhamento um conhecimento mais profundo através do instrumento
da Avaliação Multidimensional que procura conhecer as várias dimensões em análise do
indivíduo, designadamente quanto ao seu capital social, cultural, económico e simbólico.
Este estudo tem por objetivo compreender a pertinência da Avaliação
Multidimensional para a elaboração dos relatórios periciais, quando solicitados no âmbito
deste Regime.
Deste modo, a metodologia desenvolvida foi o estudo de caso, com caráter
qualitativo, pela realização de entrevistas a um grupo de 16 profissionais, como atores
judiciários nacionais, interventores sociais, organizações da sociedade civil e
interventores na área da saúde, pertencentes ao Distrito Judicial do Porto. De forma, a
tratar os dados recorreu-se à análise de conteúdo e análise documental.
Os resultados obtidos nesta dissertação mostraram-se significativamente positivos
quanto à implementação de equipas multidisciplinares, com técnicos especializados,
fornecendo o conhecimento técnico necessário e exigido para os vários intervenientes no
âmbito deste processo, nomeadamente os decisores.
This dissertation addresses the importance of Multidimensional Assessment in the Legal System for the Adult Accompanied, introduced by Law No. 49/2018 of 14 August, which revoked the Interdiction and Disability regime. Understanding the needs of each individual in particular becomes essential to fight the so-called “broad” measures of the old regime. Supporting the capacity that the individual still has, although in a conditioned way, is the foundation of the new Legal Regime. Aging, as a way of limiting capacity does not necessarily imply a restrictive or limiting measure of a person's freedom. Therefore, in the application of the accompanying measure, a deeper knowledge prevails through the Multidimensional Assessment tool that seeks to know the various dimensions under analysis of the individual, namely regarding their social, cultural, economic and symbolic capital. This study aims to understand the relevance of Multidimensional Assessment for the preparation of expert reports, when requested under this Regime. Thus, the methodology developed was a case study, with a qualitative character, by conducting interviews with a group of 16 professionals, such as national judicial actors, social actors, civil society organizations and actors in the health area, belonging to the Judicial District from Porto. In order to treat the data, content analysis and document analysis were used. The results obtained in this dissertation were shown to be significantly positive regarding the implementation of multidisciplinary teams, with specialized technicians, providing the necessary and required technical knowledge to the various actors involved in this process, namely decision makers.
