O Sistema de Investigação Criminal e o papel da Guarda Nacional Republicana: contributos para uma possível reformulação

dc.description.abstractO Sistema de Investigação Criminal em Portugal desempenha um papel crucial na conservação da segurança pública e no combate à criminalidade. A Guarda Nacional Republicana, enquanto parte integrante deste Sistema, é um Órgão de Polícia Criminal que se distingue pela proximidade dos cidadãos e pela dispersão territorial. Numa sociedade em constante mudança é premente aferir se o Sistema de Investigação Criminal, estruturado pela Lei de Organização da Investigação Criminal, ainda responde cabalmente aos desafios decorrentes de mudanças na realidade criminal e à inevitável evolução dos Órgãos de Polícia Criminal. Assim, o presente Trabalho de Investigação Aplicada tem como objetivo identificar possíveis reformulações no Sistema de Investigação Criminal que promovam a eficácia operacional e o contributo da Guarda Nacional Republicana. A metodologia empregue foi de caráter misto, uma vez que foram utilizados métodos qualitativos e quantitativos. O principal método de recolha de dados consubstanciou-se na realização de 40 entrevistas. Concomitantemente, foram recolhidos dados na Direção de Investigação Criminal da Guarda Nacional Republicana, no Departamento de Investigação Criminal da Polícia de Segurança Pública e na Direção Geral de Política de Justiça. Para o tratamento dos mesmos, recorreu-se aos softwares Statistical Package for the Social Sciences e NVivo. Esta investigação contribui para uma melhor compreensão do Sistema de Investigação Criminal em Portugal e do papel da Guarda Nacional Republicana neste contexto. Através da análise dos dados recolhidos, foram identificadas possíveis reformulações que promovam a eficácia operacional e o contributo da Guarda Nacional Republicana, das quais se destacam a reformulação da Lei de Organização de Investigação Criminal e o fortalecimento das capacidades da Guarda na investigação de criminalidade tributária, fiscal e aduaneira, criminalidade violenta e grave, criminalidade ambiental e criminalidade rodoviária. Os resultados deste estudo fornecem insights valiosos para a implementação de melhorias no sistema, visando otimizar o desempenho e o impacto da Guarda Nacional Republicana na Investigação Criminal em Portugal.pt_PT
dc.description.abstractThe Criminal Investigation System in Portugal plays a crucial role in maintaining public safety and fighting crime. The National Republic Guard, as an integral part of this system, is a Criminal Police Bodie that is characterised by its proximity to citizens and its territorial dispersion. In a society that is constantly changing, it is crucial to assess whether the Criminal Investigation System, structured by the Criminal Investigation Organization Law, still fully meets the challenges arising from changes in the criminal reality and the inevitable evolution of the Criminal Police Bodies. The aim of this Master's Thesis is to identify possible reformulations in the Criminal Investigation System that will promote the operational effectiveness and contribution of the National Republican Guard. The methodology employed was of a mixed nature, since both qualitative and quantitative methods were used. The main data collection method was 40 interviews. At the same time, data was collected from the Criminal Investigation Directorate of the National Republican Guard, the Criminal Investigation Department of the Public Security Police and the General Directorate of Justice Policy. The Statistical Package for the Social Sciences and NVivo software’s were used to process the data. This investigation contributes to a better understanding of the Criminal Investigation System in Portugal and the role of the National Republican Guard in this context. Through the analysis of the data collected, possible reformulations have been identified to promote the operational effectiveness and contribution of the National Republican Guard, including the reformulation of the Criminal Investigation Organization Law and the strengthening of the Guard's capabilities in the investigation of tax, fiscal and customs crime, violent and serious crime, environmental crime and road crime. The results of this study provide valuable insights for implementing improvements to the system, with a view to optimising the performance and impact of the National Republican Guard in Criminal Investigation in Portugal.pt_PT
