Abstract(s)
A partilha civil-militar de infraestruturas militares, reconhecida como tal, teve início no Reino Unido nos anos 80 do século passado. Em Portugal tornou-se prática corrente durante a década seguinte, procurando-se por esta via rentabilizar o excesso de infraestruturas à disposição das Forças Armadas.
A formalização da partilha é, em regra, efetuada através da celebração de um protocolo, assente na aplicação do princípio da onerosidade previsto no Regime Jurídico do Património Imobiliário Público, aprovado pelo Decreto-Lei n.º 280/2007, de 07 de agosto.
A pesquisa foi orientada pelo objetivo geral definido: formular contributos para um modelo de gestão partilhada civil-militar de infraestruturas militares, na garantia da salvaguarda das atividades de cariz militar, designadamente as de base operacional relativas à organização e emprego de forças militares, e de uma instituição militar comprometida com os interesses estratégicos regionais e nacionais que visam a segurança e o bem-estar das populações.
Da análise bibliográfica efetuada, do estudo de casos existentes e das entrevistas realizadas, para os fins deste Trabalho de Investigação Individual, ressaltam evidentes vantagens na partilha de infraestruturas militares com entidades civis, com benefícios para Portugal, mas, também, aspetos que necessitam de ser acautelados.
The civil-military sharing of military infrastructures, recognized as such, began in the United Kingdom in the 1980s. In Portugal, it became common practice during the following decade, seeking to make the most of the excess infrastructures available to the Armed Forces. The formalization of sharing is, as a rule, carried out through a protocol, based on the application of the principle of onerousness foreseen in the Legal Regime of Public Real Estate Heritage, approved by Decree-Law ner 280/2007, of august 07th. The research was guided by the defined general objective: to formulate contributions to a model of shared civil-military management of military infrastructures, in guaranteeing the safeguarding of activities of a military nature, namely those of an operational base related to the organization and use of military forces, and of a military institution committed to regional and national strategic interests aimed at the safety and well-being of populations. From the bibliographic analysis carried out, the study of existing cases and the conducted interviews, for the purposes of this Individual Research Work, the evident advantages of sharing military infrastructure with civil entities stand out, with benefits for Portugal, but also aspects that need to be taken care of beforehand.
