Abstract(s)
A presente dissertação versa sobre o consentimento como fundamento para a proteção de dados e o objetivo é demonstrar essencialmente a importância do consentimento e os seus critérios para a determinação da licitude do tratamento dos dados pessoais. Neste contexto, esta pesquisa será baseada em toda legislação sobre proteção de dados pessoais, relevante para conseguirmos atingir o objetivo proposto. Analisaremos de forma mais aprofundada o Regulamento (UE) 2016/679 do Parlamento Europeu e do Conselho de 27 de abril de 2016, relativo à proteção das pessoas singulares no que diz respeito ao tratamento de dados pessoais e à livre circulação de dados, Regulamento Geral de Proteção de Dados (RGPD) e isto por se tratar de um instrumento legal atual e vigente. Será igualmente feita uma análise menos minuciosa da Diretiva 95/46/CE do Parlamento Europeu e do Conselho de 24 de Outubro de 1995 por esta ter sido revogada para dar lugar ao RGPD. Assim sendo, o RGPD será a fonte principal por tratar-se de um instrumento jurídico vigente, cuja aplicação e abrangência, atua essencialmente dentro da UE, mas, também impacta a esfera jurídica internacional. Num segundo momento, analisaremos a realidade de Angola e de Portugal tendo em conta os seus respetivos ordenamentos jurídicos no que concerne as normas de proteção de dados, atendendo igualmente aos seus contextos sociais. A relevância do tema da proteção de dados pessoas aqui em análise, prende-se com a sua atualidade, pois, é notório que o desenvolvimento, o crescimento e a dependência do ser humano face às novas tecnologias, entre outras questões, faz com que haja à necessidade de se analisar os desafios diários inerentes à evolução da ciência tecnológica, razão que torna extremamente necessária a criação de normas que podem e devem produzir efeitos jurídicos na esfera social, começando pelo respeito dos inúmeros princípios jurídicos que garantam que o tratamento dos dados pessoais respeitem o fundamento do consentimento tal como previsto no RGPD. Por último, tendo em conta que esta matéria está intrinsecamente ligada aos direitos fundamentais, que gozam de proteção constitucional, e à constante luta pela determinação da defesa do princípio da dignidade humana, entendemos que o tema assume especial relevância pela importância que a carta magna representa para a temática em estudo.
This dissertation deals with consent as a basis for data protection and the objective is to demonstrate essentially the importance of consent and its criteria for determining the lawfulness of the processing of personal data. In this context, this research will be based on all legislation on personal data protection, relevant to achieving the proposed objective. We will analyze in great depth the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of data, as it is a current and valid legal instrument. A less detailed analysis will also be made of Directive 95/46/EC of the European Parliament and of the Council of October 24, 1995, considering that it has been repealed to make way for the GDPR. Therefore, the GDPR will be the main source because it is a current legal instrument, whose application and scope, acts essentially within the EU, but also impacts the international legal sphere. In a second step, the realities of Angola and Portugal will be analyzed, taking into account their respective legal systems regarding data protection standards and their social contexts. The relevance of the topic of personal data protection under analysis here is related to its current relevance, since it is clear that the development, growth and dependence of human beings on new technologies, among other issues, makes it necessary to analyze the daily challenges inherent to the evolution of technological science, which is why it is extremely necessary to create standards that can and should produce legal effects in the social sphere, starting with respect for the numerous legal principles that guarantee that the processing of personal data respects the basis of consent as provided for in the GDPR. Finally, given that this matter is intrinsically linked to fundamental rights, which enjoy constitutional protection, and to the constant struggle to determine the defense of the principle of human dignity, we understand that this topic assumes special relevance due to the importance that the constitution represents for the subject under study.
