| dc.description.abstract | Os crimes contra a autoridade pública, nomeadamente, a violência perpetrada contra polícias é um fenómeno crescente, aliado ao facto dos recursos e condições de trabalho para estes profissionais serem cada vez menores. Prova disso é que a prática do crime do resistência e coação sobre funcionário tem vindo a aumentar nos últimos tempos, podendo estar em causa a autoridade policial que se encontra, todos os dias, na linha da frente a representar o Estado. A libertação do arguido detido em flagrante delito pela suspeita da prática deste crime, quando não é possível a sua apresentação imediata à autoridade judiciária, ao invés da recolha às salas de detenção, é um tema discutido no seio policial, tendo a presente investigação o objetivo de compreender se tal facto coloca em perigo o bem jurídico tutelado pela norma incriminadora. Para o efeito, foram realizadas entrevistas a especialistas na área do Direito Penal e Processual Penal, bem como a oficiais da Polícia de Segurança Pública com vasta experiência policial. Com a realização da presente dissertação de mestrado foi possível concluir que para efeitos de prevenção geral e especial existe uma inadequação na libertação do arguido detido pela prática do crime de resistência e coação sobre funcionário, sendo necessário um reforço na proteção do bem jurídico tutelado pela norma incriminadora. | pt_PT |
| dc.description.abstract | Crimes against public authority, in particular violence against police officers, is a growing phenomenon, coupled with the fact that resources and working conditions for these professionals are scarce. Proof of this is the fact that the crime of resisting or obstructing an officer has been on the rise recently, calling into question the police authority that is on the front line representing the state every day. The release of defendants detained on suspicion of committing this crime, when it is not possible for them to be immediately presented to the judicial authority, instead of being taken to detention rooms, is a debated topic, and the aim of this investigation is to understand whether this fact jeopardizes the legal asset protected by the criminal law. To this end, interviews were conducted with experts in the field of criminal law and criminal procedure, as well as with Public Security Police officers with extensive police experience. With this master’s thesis, it was possible to conclude that, for the purposes of general and special prevention, there is an inadequate release of the accused detained for the crime of resisting and obstructing an officer, and that it is necessary to reinforce the protection of the legal asset protected by the incriminating rule. | pt_PT |
