Abstract(s)
No presente artigo são abordados os principais desafios do Direito Penal, na atualidade, à luz dos Direitos Humanos das mulheres, ou seja, a evolução do tratamento da mulher no Direito Penal, em particular as questões relacionadas com a separação entre um plano material e um plano simbólico da realidade social, o que inspirou o conceito de efeitos simbólicos das leis, i.e., os efeitos que as leis teriam para além dos comportamentos, sobre as representações sociais, como defendia Jürgen Habermas (Guibentif, 2007). E é neste aspeto que continuamos a situar o maior desafio do Direito Penal, sobretudo quando pensamos na velocidade das representações sociais e a velocidade da legislação, situação que se agudiza em contextos multiculturais, materializando a bifurcação do Direito.
In this article, the main challenges of Criminal Law at the present time are addressed, in light of the Human Rights of women, in short, brevitatis causa, that is, the evolution of the treatment of women in Criminal Law, in particular issues related to the separation between a material plane and a symbolic plane of social reality, which inspired the concept of symbolic effects of laws, i.e., the effects that laws would have beyond behavior, on social representations, as defended by Jürgen Habermas (Guibentif, 2007 ). And it is in this aspect that we continue to situate the greatest challenge of Criminal Law, especially when we think of the speed of social representations and the speed of legislation, a situation that becomes more acute in multicultural contexts, materializing the bifurcation of Law.
