As penas disciplinares constituem uma forma de punir os comportamentos ilícitos
dos trabalhadores, in casu dos polícias, visando fins de punição, bem como de prevenção
geral e especial. No entanto, a Polícia de Segurança Pública tem o poder discricionário de,
ex officio, suspender a execução da pena disciplinar mediante a apreciação da
personalidade do arguido, das suas condições de vida, da sua conduta anterior e posterior à
infração e das circunstâncias desta, sendo estes pressupostos materiais imperativos para, de
forma fundamentada, se poder aplicar o instituto da suspensão da execução da pena
segundo um juízo de prognose favorável ao arguido quanto à sua conduta futura.
Através de uma abordagem qualitativa procurou-se, analisando o conteúdo dos
relatórios dos instrutores dos processos disciplinares e dos despachos dos respetivos
decisores finais, aceder ao tipo de argumentação expendida nos processos, se
fundamentada ou se conclusiva, e, ainda, destacar os esquemas argumentativos que
permitam perceber se todos os pressupostos materiais imperativos são apreciados na
decisão.
Disciplinary penalties are a form of punishment for the illicit behavior of workers, in casu of the policemen, for the purpose of punishment, as well as general and special prevention. However, the Public Security Police has the discretionary power, ex officio, to suspend the execution of the disciplinary penalty by appraising the personality of the accused, their living conditions, their previous and subsequent conduct and the circumstances of the offense, these imperative assumptions are material to, in a reasoned manner, applied if the institute of the suspension of the execution of the penalty according to a prognosis judgment is favorable to the defendant as to his future conduct. Through a qualitative approach, we analyze the contents of the reports of the instructors of the disciplinary processes and of the dispatches of the respective final decision makers, the type of argument presented in the cases, whether based or conclusive, and also to highlight the argumentative schemes, that make it possible to see whether all imperative material assumptions are appreciated in the decision.
